Jan. 6 defense attorney moves to dismiss case amid allegations FBI altered evidence

"...[T]he FBI is explicitly making a mockery of Fourth, Fifth, and Sixth Amendment restrictions in order to wrongly convict the defendants," Roots writes.

Quote

Attorney Nick Smith, who represents Pezzola co-defendant Ethan Nordean, revealed classified FBI emails that included an order to Miller that she remove an FBI agent from the informant report and destroy 338 pieces of evidence outright.

Facts like this keep coming out in dribs and drabs that stink to high heaven - and NOTHING is being done about it. The DC judges are unreal. These people are having their lives ruined, and if ever anything is done about it - it will be too late (already is in some cases) to even matter. Justice delayed is justice denied.

* This more than anything Really Ticks people off. As well it should.

** 95% Democrat, To get anything like a fair trial in the DC area is a pipe dream.

There is a reason Federal Prosecutors have a 95% conviction rate. To quote "If Federal Prosecutors want to get you, you're going away."

How I Knew The Democrats and The Media Were Lying About January 6th

Utopias by their nature have only two options if they’re to survive. They must lean into totalitarianism or collapse. We’re now at the moment when the Democrats, with complete control of the legacy media, nearly all major institutions of power — including those run by the government — are slowly adopting totalitarian practices to shut out speech they don’t like.

Utopia

Social Justice Usage

Source: Giroux, Henry. On Critical Pedagogy. Continuum, 2011, p. 122.

Utopian thinking in this view is neither a blueprint for the future nor a form of social engineering, but a belief that different futures are possible. Utopian thinking rejects a politics of certainty and holds open matters of contingency, context, and indeterminancy as central to any notion of agency and the future. This suggests a view of hope based on the recognition that it is only through education that human beings can learn the limits of the present and the conditions necessary for them to “combine a gritty sense of limits with a lofty vision of possibility.” Educated hope poses the important challenge of how to reclaim social agency within a broader discourse of ethical advocacy while addressing those essential pedagogical and political elements necessary for envisioning alternatives to global neoliberalism and its attendant assault on public time and space.

New Discourses Commentary

“Utopia” is a complicated topic both within and outside of the Theory of Critical Social Justice (and its Theoretical predecessors). This complexity probably arises because it is highly sought after but does not (and cannot) exist. A Utopia, which literally derives from Greek root words meaning “nowhere,” is a perfect, or perfected, society or social order. In the Theory of Critical Social Justice, Utopia would be a social state in which there is no systemic power or oppression of any kind and thus no group conflict (see also, conflict theory), injustice, or inequity (see also, democracy). Throughout Theory and its intellectual predecessors (see also, Critical Theory, neo-Marxism, Marxism, Hegelian, and postmodernism), Utopia is variously described, criticized, held up as an ideal, and offered as a mischaracterization of their aims, depending on the writer and their operative definition of the term. This makes it hard to say definitively that Woke Theory is Utopian in character, though it plainly is.

Revelation of FBI Informants Shakes Proud Boys’ January 6 Trial

Revelations of the sheer number of FBI informants involved in the January 6, 2021 Capitol riot have shaken a trial of members of the Proud Boys in Washington, DC, as one FBI informant had infiltrated the defense team.

As Julie Kelly, who has covered the January 6 trials extensively, reports, there are at least ten informants now known to have been involved in the Proud Boys — more than twice the five defendants who are on trial.:snip:

According to an earlier TGP report:

The FBI called Jeremy’s cellphone and asked for a meeting after trying to contact him at his house. Jeremy then met with the FBI agents at a restaurant in Ybor City in December. He told Brandon Gray that 38 seconds into the interview the FBI attempted to recruit him to spy on the Oath Keepers.

Two years later, Jan. 6 video footage raises new questions about police and prosecutors

Two years after the Jan. 6 Capitol riot, the issue of security footage is bedeviling law enforcement as federal prosecutors belatedly admit there is footage of some cops consorting with the riotous crowd and a retired Capitol Police executive divulges there are sizzle reels of all defendants inside the Capitol that were prepared for the FBI

A biased Oath Keeper juror speaks

This March 28 Politico article by Kyle Cheney should be reviewed by counsel for cause to reverse the Oath Keepers convictions.

Juror in Oath Keepers trial reveals secrets from the deliberation room

Cheney's article was based on a post-trial interview with the juror identified only as "Ellen" who worked for C-SPAN for 32 years and, as the article suggests, came away from her experience having scant regard for the ability of (other) jurors to absorb trial testimony -- to the point where, if she were to find herself on trial,  she would prefer the matter decided by the judge.

Target Of ‘Reconnaissance Tour’ Story Fires Back At January 6 Committee
Daniel Chaitin
Mar 29, 2023

(Snip)

The congressman pointed to the January 6 Committee’s final report, which the timeline document faults for “repeating false claim of Loudermilk giving ‘a tour of the Capitol.'” That final report, released in December, also briefly discusses a tour participant who attended former President Donald Trump’s January 6 rally on the Ellipse. But this individual, Trevor Hallgren, told the committee he only ever got within 100 to 300 yards of the Capitol building on January 6 and he has not been accused of any crimes in connection to the breach.

The congressman published a video showing the January 6 Committee’s “selective” clips of the tour followed by the “full” footage of him on January 5. In addition, Loudermilk shared video from one of the visitors in the group that his office says the January 6 Committee received and “shows that the group was solely watching the Congressman go to vote.”

In conclusion, Loudermilk said, “It’s clear their work isn’t credible, and they owe every individual whose reputation they attempted to smear an apology.”

‘QAnon Shaman’ Jacob Chansley Released From Prison

Jacob Chansley, who is best known as the “QAnon Shaman” from the Jan. 6, 2021 Capitol riot, has been released from prison, according to his lawyer.

“For the record: Jake is out on schedule,” tweeted his lawyer, Bill Shipley, early Thursday morning.

The Federal Bureau of Prisons (BOP) website showed on Thursday that Chansley, a 35-year-old from Arizona, has been moved to a Residential Reentry Management office in Phoenix.

“I told him 16 months ago in our first conversation it would be Feb. or Mar. 2023,” Shipley added. “BOP. math. I didn’t do anything extraordinary — this was always the schedule, I just understood it and could explain it to him. He was expecting 12 more mos.”

JANUARY 6TH INFILTRATION FROM HOMELAND SECURITY?! Proud Boys Defense Attorney Says 19 DHS Undercover Informants/Agents Infiltrated on January 6th!

While attorneys debate the matter of what constitutes “conspiracy” on day 51 of the Proud Boys’ trial, new information uncovered by CondemnedUSA, raises a multitude of questions about the full extent of government operations at the Capitol on January 6th, 2021.

According to a motion by Proud Boys Defense Attorney Roger Roots:

“(Defendant) Pezzola has become aware that the largest numbers of undercover CHSs on Jan. 6 belonged to agencies other than FBI.

At least two law enforcement agencies each outnumbered the FBI in terms of running undercover agents, informants, and CHSs on Jan. 6. First, the DC Metro Police had at least 13 undercover plain-clothes agents among the Proud Boys and other patriots on Jan. 6. Next, there appear to have been some 19 CHSs on Jan. 6 belonging to an agency called HIS (Homeland Security Investigations). When added to the 8 FBI CHSs now acknowledged by the prosecutors, this means that there were at least forty (40) undercover informants or agents doing surveillance among defendants on January 6.”:snip:

‘At Least 40’ Undercover Informants Were Doing Surveillance on January 6, Defense Lawyer Says

Law enforcement agencies had at least 40 undercover informants engaging in surveillance work among defendants on Jan. 6, defendant Dominic Pezzola’s lawyer Roger Roots said Wednesday.

A Proud Boys member, Pezzola is currently standing federal trial in Washington, D.C. with the group’s former national chairman Enrique Tarrio and members Ethan Nordean, Joseph Biggs, Zachary Rehl for allegedly conspiring to oppose the Jan. 2021 transfer of presidential power and related charges. The government admitted Tuesday that eight FBI confidential human sources were embedded among the Proud Boys on Jan. 6, Roots reported in a Wednesday court filing, saying the Homeland Security Investigations (HIS) agency appears to have had some 19 informants active at the time.:snip:
