The Jan. 6 select committee is preparing to vote on urging the Justice Department to pursue at least three criminal charges against former President Donald Trump, including insurrection.

The report that the select panel is expected to consider on Monday afternoon, described to POLITICO by two people familiar with its contents, reflects some recommendations from a subcommittee that evaluated potential criminal referrals. Among the charges that subcommittee proposes for Trump: 18 U.S.C. 2383, insurrection; 18 U.S.C. 1512(c), obstruction of an official proceeding; and 18 U.S.C. 371, conspiracy to defraud the United States government.

It’s unclear whether the select committee’s final report will recommend additional charges for Trump beyond the three described to POLITICO, or whether it will urge other criminal charges for other players in Trump’s bid to subvert his 2020 loss. The document, according to the people familiar, includes an extensive justification for the recommended charges.

 

To justify incitement of insurrection, the report references U.S. District Court Judge Amit Mehta’s February ruling saying Trump’s language plausibly incited violence on Jan. 6, 2021, when a mob of his supporters besieged the Capitol in a bid to disrupt congressional certification of his loss to Joe Biden. The report also cites the Senate’s 57 votes in last year’s impeachment trial, Trump’s second, to convict him on an “incitement of insurrection” charge passed by the House.

In one of its final acts, the House January 6 Committee warned the White House it cannot ensure the confidentiality of certain witnesses.

JUSTICE HAS ARRESTED 950 CAPITOL PROTESTERS, SNIFFING AROUND FOR MORE

 

WASHINGTON — 

Almost two years after the January 6, 2021, attack on the U.S. Capitol, the sprawling federal investigation into the riot continues at an “unprecedented speed and scale,” with more than 950 people arrested, U.S. Attorney General Merrick Garland said Wednesday.

That number represents less than half of an estimated 2,000 to 2,500 supporters of former President Donald Trump believed to have breached the Capitol as lawmakers met to certify the results of the 2020 presidential election.

But Garland, the nation’s chief law enforcement officer, said the Justice Department remained determined to bring every lawbreaker to justice.

“We remain committed to ensuring accountability for those criminally responsible for the January 6 assault on our democracy,” Garland said in a statement. “And we remain committed to doing everything in our power to prevent this from ever happening again.”

David Sundberg, assistant director in charge of the FBI Washington Field Office that has been leading the federal investigation, indicated the probe could take years.:snip:

Trump supporters marched around the US Capitol on Friday afternoon to commemorate the 2nd anniversary of January 6.

Police arrested Ashli Babbitt's mother Micki Witthoeft during the march, which drew counter-protesters to follow and criticize the Trump supporters as they placed flowers and posters outside the barricades.

Martin Luther King III spoke out Friday along with his wife Arndrea Waters King in front of the US Capitol at a" #Jan6Justice" rally where he described the event two years ago as "tragic history" and contrasted it from his father's approach of non-violence.

Legal Filing Exposes FBI Involvement in January 6th

It’s a story as old as time. Something bad happens and completely unexpectedly, it turns out the FBI was involved. Sure enough, despite years of the left dismissing the possibility as a conspiracy theory, a new legal filing serves as an admittance that the FBI was very much involved in the events of January 6th.

Ironically, we are finding that out because the government is once again trying to cover up exactly what happened. Regarding the case of Proud Boy Ethan Nordean, federal prosecutors are asking a judge to limit defense questions on the matter.:snip:

Missing Documents and Files in Ongoing J6 Cover-Ups

Overclassification ensures the public won’t get a full view into the government’s behind-the-scenes machinations leading up to the events of January 6.

The public is gradually learning how, despite repeated denials and non-answers, top government officials were well aware of the potential for violence on January 6, 2021. 

A chief investigator on the January 6 select committee told NBC News last week that law enforcement was privy to a trove of intelligence indicating problems could arise during the election certification process but, for some unexplained reason, chose to ignore the warning signs. “The Intel in advance was pretty specific, and it was enough in our view for law enforcement to have done a better job operationalizing a secure perimeter.” Tim Heaphy told NBC News reporter Ken Dilanian. “Law enforcement had a very direct role in contributing to surely the failures—the security failures that led to the violence.”

Criticism of law enforcement, as I noted here after the release of the committee’s report, was buried in a relatively brief appendix in the 840-page document. Staffers complained for months that former Representative Liz Cheney (R-Wyo.) insisted the final work product singularly blame Donald Trump, not government agencies, for the events of January 6.

Cheney got her way. But now that the committee is dissolved, some are going public to reveal what the committee failed to report—and the omissions are far more consequential than private conversations between Ivanka Trump and her father, another odd fixation of Cheney’s. (Perhaps a bit of projection from Dick Cheney’s daughter?)

The New York Times disclosed last week that the FBI conducted a tabletop exercise of sorts to “game out the worst potential outcomes of a disputed election.” The so-called “red cell” analysis took place on October 27, 2020, and envisioned four post-election outcomes related to a “lone offender” attack. The bureau did not, however, consider the possibility of a mass uprising or coordinated assault by alleged “militia” groups on January 6, the Times reported.:snip:

Explosions in the Courtroom! DOJ’s Star Witness and Turncoat’s Testimony COLLAPSES! Proud Boy Prosecutors Clamor to MUZZLE the Defense After Court Disaster!

Last week at the Proud Boy Trial, a former Proud Boy and rat took the stand as a government witness against the group of American patriots.

The Department of Injustice’s star turncoat found himself in the crosshair of his worst enemy: His very own testimony.

Jeremy Bertino was a former Proud Boy, and videos have shown him to be one of the biggest agitators at rallies. Coincidentally, he is now working with the Government. Called “Noble Beard” by his former friends when he was an active Proud Boy (most Proud Boys have nicknames), the tall pencil-thin long bearded rat threw his five friends under the bus to save his own backside. It was revolting to watch.

Bertino, now property of the DOJ, clearly made a sweet deal with the government in exchange for incriminating testimony to help put his former drinking buddies in jail for decades. Arrested after January 6th for additional weapons charges that were found in his home in an FBI raid, Bertino has not yet seen jail time (unlike his five friends on trial). The government is holding the weapons charges over his head to get the testimony they need out of him to further their agenda of convicting the Proud Boys of “Seditious Conspiracy” and ultimately tying them to President Trump.

The bearded traitor perjured himself under oath multiple times and contradicted his own FBI interviews to cooperate with his new masters- the diabolical prosecutors. The desperate new conspiracy theory the prosecutors are feeding the biased D.C. jury is that the Proud Boys were so angry that their buddy Bertino (the rat) was stabbed by Antifa in a December rally before January 6th that they decided to take it out on police and the government. As a result they planned the fabled “Insurrection” of January 6th and committed “Seditious Conspiracy” all based on Bertino’s wound.:snip:

Release of Jan. 6 video footage to Tucker Carlson is a five-alarm fire for Democrats

House Speaker Kevin McCarthy ’s decision to hand over security footage from the Jan. 6 Capitol riot to Fox News host Tucker Carlson has Democrats up in arms.

For two years, Democrats, citing “security concerns,” have managed to withhold this critical footage from the public, likely fearing it would contradict their carefully constructed narrative that the riot had been “an insurrection” and “terrorist attack.”

Democrats are especially peeved with whom McCarthy chose to provide the material to. They consider it an attempt to curry favor with Carlson, who has been openly critical of the GOP leader in the past. And while that may very well be true, there’s no question that Democrats’ main problem with Carlson is that he has repeatedly questioned the decisions, actions, and motives of the Department of Justice, then-House Speaker Nancy Pelosi (D-CA), Washington Mayor Muriel Bowser, and the House Jan. 6 committee.

A Partisan Judge’s Parting Rampage

The queen of January 6 jurisprudence, Judge Berry Howell is a shameless partisan willing to twist the law, and the U.S. Constitution, to advance her own political agenda.

 

Defense lawyers call it “January 6 jurisprudence”—a unique set of rules and laws that only apply to those ensnared in the Justice Department’s unstoppable push to punish individuals who do not believe Joe Biden is the legitimately elected president of the United States. So far, nearly 1,000 Americans have been arrested and charged, mostly on low-level misdemeanors, for their involvement in the Capitol protest as the regime circles its ultimate prize: Donald Trump.

The fundamental “crime” that acts as the basis of January 6 jurisprudence is not necessarily the four-hour disturbance that temporarily delayed the certification process that day. No, the real crime—to hear regime apparatchiks, the media (but I repeat myself), and Democratic Party politicians (including Biden himself) tell it—is promoting the “Big Lie,” the notion that the 2020 presidential election was rigged or stolen.

Efforts to uncover election irregularities or lawfully object to the outcome are under criminal investigation resulting in the unprecedented weaponization of legal and judicial authority conducted by unaccountable prosecutors and judges.

Enabling this farce in the nation’s capital is Beryl Howell, the chief judge of the D.C. District Court. A former Democratic staffer on Capitol Hill, Howell was appointed to the bench by Barack Obama in 2010 and elevated to chief judge in 2016. Since then, Howell has steered the government’s yearslong effort to put Trump in handcuffs. She managed the grand jury proceedings for Special Counsel Robert Mueller and is currently overseeing the Justice Department’s latest iteration of its “Get Trump” campaign—a sweeping investigation into alleged attempts to “overturn” the 2020 election.

Her latest broadside is aimed at Representative Scott Perry (R-Pa.). FBI agents, acting at the direction of the rogue Washington Field Office, stole Perry’s cell phone on August 9, 2022, the day after the same office executed an armed raid at Mar-a-Lago. Perry was traveling with his family in New Jersey at the time when agents seized his phone, copied its contents, and returned the device. 

Perry’s lawyers immediately attempted to keep the contents of the phone out of the hands of a leak-happy Justice Department, citing privacy and privilege factors, including the Constitution’s speech and debate clause, which basically protects the legislative branch from retaliatory actions by the executive branch. When Perry initially refused to waive that protection at the request of the Justice Department, the government successfully sought a second warrant a few days later to review what investigators collected from the phone.

And that’s when Judge Howell stepped in.

“After a determination that there was probable cause to believe that evidence of criminal activity would be found on the targeted cell phone, the government’s search warrant was approved,” Howell wrote in one motion filed in the mostly sealed case.

The second search warrant was reportedly approved by Howell on August 18.

Since then, Howell has wielded her power to prove herself right. A grand jury under her purview is “investigating potential federal criminal law violations stemming from efforts to overturn the 2020 presidential election,” Howell wrote. According to the government, Howell noted, Perry used his phone “to communicate with individuals allegedly engaged in those efforts over critical time periods at issue in the investigation.”

That’s just a sliver of the crazy talk in Howell’s 51-page motion rejecting most of Perry’s arguments about why roughly 2,200 emails and texts qualify for protection under the speech and debate clause. Perry’s motions remain under seal, but his privilege claims appear to be centered around Congress’ obligations to administer the Electoral Count Act.:snip:

Jan. 6 defendants at CPAC say Republican leaders have forgotten them

Demonstrators who were arrested and charged for storming the U.S. Capitol on Jan. 6, 2021, claimed a spot at the Conservative Political Action Conference and railed against federal prosecutors, Republican lawmakers and CPAC itself for mistreating them.

They said they have been shut out of the banking system, de-platformed from social media, blacklisted from flying on commercial airlines — wrecked financially and socially — and, worse of all, forgotten by most conservative leaders in Washington.

 

At a panel discussion titled “True Stories of January 6: The Prosecuted Speak,” they described a saga of persecution and abandonment:

• They were ignored or ghosted by Republican lawmakers who once claimed to champion their cause.

• They were left out of the equation when House Speaker Kevin McCarthy turned over Capitol surveillance video from Jan. 6 to Fox News’s Tucker Carlson, despite promises to make the video available to the public.:snip:

A Handy January 6 Fact Sheet  - Julie Kelly

In another example of Washington’s inexorable slide into banana republic territory, Senate Majority Leader Charles Schumer (D-N.Y.) took to the floor of the U.S. Senate on Tuesday to call for the removal of an American journalist. 

“I don’t think I’ve ever seen an anchor treat the American people, and American democracy, with such disdain,” Schumer said during his seven-minute authoritarian tirade. “And he’s going to come back tonight with another segment. Fox News should tell him not to. Fox News, Rupert Murdoch—tell Mr. Carlson not to run a second segment of lies. You know it’s a lie.”

Schumer later reiterated his demand to a group of journalists who, rather than denounce one of the most powerful government officials in the country attempting to silence an influential member of the media, dutifully reported Schumer’s bleating without question.

Republican senators including Senate Minority Leader Mitch McConnell (R-Ky.) and Senator Mitt Romney (R-Utah) joined the fray, echoing Schumer’s faux concerns over “national security.”

Clearly, it’s panic time. The White House, Congress, and the Democratic Party propaganda arm that is the corporate media realize their carefully engineered narrative about January 6 is imploding in real time. Which is why they’re accusing Carlson of “whitewashing” and “rewriting” the events of January 6. Anything less than total fealty to regime-approved talking points about what happened before and after that day now is considered a “threat to democracy.”

But facts are facts. And no amount of pearl-clutching by the hags on “The View” or threats made by U.S. senators can alter the reality of January 6. Between video recordings, witness testimony, court filings, and news reporting, the undeniable truth about January 6 cannot be willfully wished away even by the most skilled spinmeisters.

Here’s what we know:

 

 

  • Some people acted badly. A handful came ready for a fight while others admit they were caught up in a mob mentality that unfolded over the course of the afternoon.
  • The overwhelming majority of protesters did not act badly or violently. Not only do security footage and other video sources demonstrate that is indeed true, the Justice Department’s own data supports it. “Parading” in the Capitol, a class B misdemeanor, is by far the most common charge in the Justice Department’s sweeping investigation. According to an update published this week, 919 out of 1,000 defendants face trespassing charges. Of the 518 who accepted plea agreements, 385 pleaded guilty to misdemeanors and 133 pleaded guilty to a felony.:snip:

A ‘Spill’ of FBI Secrets

Americans will hold accountable those responsible for the accelerating degradation of the U.S. justice system as the government's J6 narrative collapses and their wrongdoing becomes apparent.

The FBI agent squirmed on the hot seat.

Confronted with messages the Justice Department attempted to conceal, Nicole Miller, one of the lead FBI investigators assigned to the Proud Boys case, was on the verge of admitting that the FBI monitored privileged communications between one defendant and his attorney in 2021.

“It appears so,” Miller responded when asked by defense attorney Nicholas Smith on March 8 to confirm she and another agent discussed the content of emails exchanged between Zachary Rehl, one of five Proud Boys currently on trial for seditious conspiracy, and his former lawyer.

Smith read aloud one of Miller’s texts: “I need to find other emails, but this one email definitely indicates that they want to go to trial, But don’t freak out, Jason and Luke.” 

Smith turned to Miller. “Now, ‘Jason,’ you understand to be referring to the prosecutor in this case, Jason McCullough. Correct?”

But jurors never heard an answer. After prosecutors loudly objected, Judge Timothy Kelly abruptly dismissed the jury. He informed jurors that he wanted “to press pause, as we sometimes do when an objection hits,” and reconvene the morning of March 9.

But that didn’t happen either.

 

 

Instead, Kelly, outside the eyes and ears of the jury, held a hearing with both sides on March 9 to determine how to proceed after the defense team uncovered messages indicating FBI agents doctored internal reports, destroyed evidence, and tipped off prosecutors about defense strategy on the government’s highest-profile January 6 case.:snip:
