The U.S. Capitol Police officer who shot and killed Ashli Babbitt inside the U.S. Capitol on Jan. 6 was exonerated by the force, according to an internal agency document.

The unidentified officer, whom the Justice Department has cleared of any charges in connection to Babbitt's death, was not found to have acted improperly following a Capitol Police investigation, NBC News reported Friday .

The memo, which originated from the commander of the Capitol Police’s Office of Personal Responsibility, said, “No further action will be taken in this matter.”

The Washington Examiner reached out to U.S. Capitol Police for comment.

Babbitt, a 35-year-old Air Force veteran and Trump supporter, was shot with a single bullet as she tried to enter through a door near the House chamber during the Capitol storming on Jan. 6. The chamber was being evacuated at the time.

The DOJ announced in April that it would not charge the officer in connection to Babbitt's death after an investigation found “insufficient evidence” to support a prosecution.

Investigators found "no evidence to establish that, at the time the officer fired a single shot at Ms. Babbitt, the officer did not reasonably believe that it was necessary to do so in self-defense or in defense of the Members of Congress and others evacuating the House Chamber,” the U.S. Attorney's Office in D.C. said.:snip:

REPORT: COP WHO KILLED ASHLI BABBITT HAS TROUBLED RECORD

For more than seven months, the U.S. Capitol Police officer who shot and killed Ashli Babbitt, an unarmed protester climbing through a broken window in a hallway of the U.S. Capitol on January 6, has remained anonymous.

Though his name was known to U.S. Capitol Police, congressional staffers and federal investigations, no one would divulge it. The secrecy fueled months of online speculation.

Babbitt’s family alleged a coverup.

“The U.S. Congress wants to protect this man. He’s got friends in high places and they want to protect him,” said Maryland attorney Terry Roberts, who represents the family. “And they’ve done a pretty good job of it. … I don’t think it’s a proud moment for the U.S. Capitol Police or the U.S. Congress.”:snip:

Byrd is a controversial figure with a record of mishandling firearms, including once leaving a loaded pistol in a Congressional Visitor Center bathroom. Roberts said Byrd’s decision to fire his weapon on January 6 indicated his unfitness for duty.

In looking at this photo I'd say he is mishandling his firearm. 1. LOOKS like his finger is on the trigger.  2. We were trained Never unholster your weapon unless you are about to discharge it, and it had better be in a life threatening situation.

On Thursday morning, a group of seven Capitol Police officers who were on duty at the US Capitol on Jan. 6, 2021 have filed a lawsuit against former President Donald Trump.

The text of the lawsuits states that "Because of Defendants’ unlawful actions, Plaintiffs were violently assaulted, spat on, tear-gassed, bear-sprayed, subjected to racial slurs and epithets, and put in fear for their lives. Plaintiffs’ injuries, which Defendants caused, persist to this day."

The lawsuit names as defendant Trump himself, as well as his campaign, his adviser Roger Stone, a group called "Stop the Steal", and other organisations such as the Oath Keepers and the Proud Boys.
