But Democrats aren't likely to let such an aggressive move slide, and the payback could get ugly with other high-court vacancies likely during Trump's first term. Incoming Democratic leader Chuck Schumer, D-N.Y., is known for playing hardball so President-elect Donald Trump and Senate Republicans now have to carefully plot their next move in the high-stakes game of filling the critical lifetime post. This week after the election, Washington is filled with talk that McConnell could up the ante on Democrats and go "nuclear," changing Senate rules to require a simple majority instead of 60 votes to end a filibuster of a president's high court pick.
