Washington (CNN)Newly released emails from Hillary Clinton's tenure as secretary of state raise questions about the nature of the department's relationship with the Clinton Foundation.

 

Judicial Watch, a conservative watchdog group, released 296 pages of emails from the Democratic presidential nominee, including 44 that Judicial Watch says were not previously handed over to the State Department by Clinton. The emails, many of which are heavily redacted, raise questions about the Clinton Foundation's influence on the State Department and its relations during her tenure.

In one instance, top Clinton Foundation official Doug Band lobbied Clinton aides for a job for someone else in the State Department. In the email, Band tells Hillary Clinton's former aides at the department -- Cheryl Mills and Huma Abedin -- that it is "important to take care of (redacted)." Band is reassured by Abedin that "Personnel has been sending him options."

Saw another email that shows Huma basically had complete access to Hillary's inbox and replied for her. I hope Huma was a "real" state dept. employee with all the right clearances, etc. I seem to recall some controversy on her being on staff.

Report: DOJ denied FBI request to investigate the Clinton Foundation

For months, there have been rumors that the FBI is investigating the Clinton Foundation for public corruption. It has been clear to me that, as I put it yesterday, “even assuming the truth of such reports, I think it’s fanciful to think that anything will come of this; the FBI has shot its wad.”

 

Now comes word, via CNN, that the FBI asked to investigate the Clinton Foundation earlier this year, but the Department of Justice said it did not have enough evidence to open a formal probe. According to CNN:

 

 

 

The FBI went to Justice Department earlier this year asking for it to open a case into the foundation, but the public integrity unit declined. The Justice Department had looked into whether it should open a case on the foundation a year prior and found it didn’t have sufficient evidence to do so.

I’m speculating now, but I think I detect a pattern in Lynch’s handling of Clinton scandals. She makes a show of deferring to the FBI when she’s confident that the FBI’s determination won’t land Hillary in legal jeopardy (see the email scandal). She (or her agents) says no to the FBI when the Bureau wants to take action that threatens Hillary (see the Clinton Foundation scandal).

 

If Lynch is auditioning for Attorney General in a Clinton administration, she’s passing with flying colors. Lynch seems like just the Attorney General Hillary will need.

Report: Clinton Foundation under federal investigation after all

A few days ago, CNN reported that the FBI asked to investigate the Clinton Foundation earlier this year, but the Department of Justice said it did not have enough evidence to open a formal probe. I wrote about this report here.

 

But now, the Daily Caller is saying that several investigations of the Clinton Foundation have been launched, including one led by U.S. Attorney Preet Bharara of the Civil Frauds Unit that will focus on Clinton Foundation in New York. The Daily Caller’s Richard Pollock identifies his source as “a former senior law enforcement official.”

 

According to Pollock’s report, Bharara’s investigatation will be supported by various U.S. Attorneys Offices. This, he says, is a major departure from other centralized FBI investigations.

What are the practical consequences of the Clinton Foundation being under investigation now, assuming that it is? It strikes me that the investigation, which almost certainly involves complicated transactions, isn’t likely to be completed before Election Day. Nor, even if it is, will the DOJ likely reach a decision to prosecute before then.

 

Once Clinton is inaugurated in January (assuming she wins), her Justice Department isn’t at all likely to charge her Foundation with criminal conduct. In the old days, an independent counsel might well have been appointed and given responsibility over the matter. But I don’t see that happening now, especially in a Hillary Clinton administration given the Clintons’ experience with Ken Starr.
