U.S. Senator Chuck Grassley of Iowa is the Chairman, Senate Committee on the Judiciary.

 

The Constitution grants the authority to nominate and approve Supreme Court Justices to coequal branches of the federal government. The President has authority to nominate a candidate for the Supreme Court, and the Senate has the authority to consent or withhold consent.

 

However, in his post, President Obama six times states that he “appoints judges to the Supreme Court.” From that fundamental misunderstanding, he reveals that the person he will nominate, not appoint, will be someone whose decisions are not tied to the Constitution’s text.

 

Like most of his nominees, the President pays lip service to the notion that judges are to “interpret the law, not make the law,” but then submits that in cases where “the law is not clear” his nominee’s views “necessarily will be shaped by his or her own perspective, ethics, and judgment.” And of course, his nominee will “arriv[e] at just decisions and fair outcomes” based on the application of “life experience” to the “rapidly changing times.”

 

The President, candidly to his credit, has unambiguously informed the American people that his nominee will apply his or her own ethics and perspectives in deciding cases. This goes to the heart of the matter

Grassley Slams Harry Reid's Tantrums over SCOTUS Nominee on Senate Floor

The Democrats have pulled out all the stops to pressure Senate Republicans to hold a vote on President Obama's eventual replacement for Justice Antonin Scalia on the Supreme Court. In particular, they are targeting Senate Judiciary Chairman Chuck Grassley (R-IA) with vile op-eds in partisan Iowa newspapers and threatening him with a challenge in his re-election bid.

 

Grassley's challenger, former Lt. Governor Patty Judge, said she will focus on Grassley's refusal to cave into the Democrats' wishes hold hearings on Obama's nominee as part of her campaign.

 

Like I said: ALL THE STOPS.

Judge Kelly Difficult to Oppose? Seriously?

Rumor has it that the Obama White House wants to nominate a successor to Justice Scalia who would be hard for Republicans to oppose. One name that has been floated is Judge Jane Kelly of the Eighth Circuit.

 

Thomas Hopson has this post at SCOTUSblog. He lists five capital cases that Judge Kelly participated in. They are all cases decided en banc or denying rehearing en banc with a dissent. In every one of five cases, a large majority of the court decides against the murderer or decides not to review a panel decision against the murderer, and in every one Judge Kelly joins the dissent.

 

While an honest judge faithfully applying the law may occasionally need to reverse a conviction or sentence or stay an execution in a case that has completed the full review cycle, these are the exceptions. Scissors-32x32.png
