Court rejects challenge to Obama climate rule

A federal appeals court on Tuesday threw out the first judicial challenge to the Obama administration’s landmark climate rule for power plants.

 

The Court of Appeals for the District of Columbia Circuit ruled that the energy companies and states that filed the lawsuit had jumped the gun, and the court cannot yet review a regulation that has only been proposed, but not made final.

 

Though the decision was widely expected, it nonetheless hands the Environmental Protection Agency (EPA) its first major win in defending President Obama’s key executive action to fight climate change.

“They want us to do something that they candidly acknowledge we have never done before: review the legality of a proposed rule,” Judge Brett Kavanaugh wrote in the opinion on behalf of himself and Judge Thomas Griffith, both appointed by Republican presidents.

President Obama spoke to the Catholic Health Association yesterday in defense of Obamacare. The White House has posted the text of his remarks here. The White House has also posted a video of the speech (below) and an overfull Web page celebrating the deep thoughts of our Dear Leader on the subject. The Supreme Courts pending decision in King v. Burwell provided the backdrop for the speech. Obama has attacked the Supreme Court for taking up King v. Burwell and asserted that only a twisted reading of the statute could account for a result he would deem unfavorable. Of the players on the American political scene, we are to believe, only Obama himself has clean hands and a pure heart. In this mode of his, the opposite of what he says is the truth. The man is beyond embarrassment. He is the political equivalent of a sociopath.
