Geee Posted March 25, 2015 Share Posted March 25, 2015 The Hill: A federal appeals court said Tuesday it will hear an expedited appeal of an earlier ruling against President Obama’s executive actions on immigration. The Fifth U.S. Circuit Court of Appeals will listen to oral argument April 17 in the administration’s attempt to overturn a ruling last month by U.S. District Judge Andrew Hanen. Hanen put a temporary hold on Obama’s attempts to slow deportations and grant benefits to some people in the country illegally, saying the administration overstepped its authority. The White House’s appeal seeks to end the temporary hold, arguing it prevents the Department of Homeland Security from protecting the borders. Geee Posted March 25, 2015 Author Share Posted March 25, 2015 FIFTH CIRCUIT SCHEDULES HEARING IN EXECUTIVE AMNESTY CASE The United States Court of Appeals for the Fifth Circuit has issued an order that sets oral argument in Texas v. United States for April 17. This is the case in which Texas and other states challenge President Obama’s executive amnesty. In district court proceedings, Judge Hanen temporarily enjoined the government from enforcing Obama’s program to grant lawful status to millions of illegal immigrants. The government has moved for a stay of that order, pending appeal. The oral argument on April 17, for which two hours have been allocated, will pertain only to the government’s motion for a stay. As for the merits of the injunction, the Fifth Circuit’s order sets a briefing schedule and permits the filing of briefs by a number of amici, including Senators Cruz and Cornyn. Looking at the make up of the court, the majority appear to be Republican President appointee's - but we all know that is not always an indication. This appeal seems to be only on the stay.
