There is no such thing as a “loophole” in the Byzantine, behemoth Internal Revenue Service code. Federal taxes function exactly as intended. They are crafted to punish political enemies and reward selected constituencies. They are written to encourage and discourage certain behaviors, and to redistribute wealth. And when people aren’t required to pay federal taxes on certain transactions or assets, they aren’t using secret accounting tricks — they’re following the law.
