The Court will hear two arguments at each of the public sittings; no hearings will be held in the afternoons. Each session begins at 10 a.m. and each hearing is scheduled for one hour. MacLean Issue: Whether certain statutory protections codified at 5 U.S.C. § 2302((8)(A), which are inapplicable when an employee makes a disclosure “specifically prohibited by law,” can bar an agency from taking an enforcement action against an employee who intentionally discloses Sensitive Security Information. This should be really interesting...not to mention important. Comes down to IMO just what is Sensitive Security Information, and who decides? Way too many things are classified and for way too long.
