Do we pass laws any more?

 

I ask because of the reaction to the federal appeals court decision in Halbig v. Burwell, in which the court enforced what the Affordable Care Act actually says—namely, that federal subsidies for health insurance are available only through state-run exchanges and not through exchanges set up by the federal government.

 

This is important because the majority of states declined to set up those exchanges—deciding to reject a system and a set of obligations foisted on them by Washington. And ObamaCare is just a big, complicated mechanism for delivering subsidies. Without that, all it does is cancel everyone’s insurance policies and force them into more expensive plans they didn’t want. So you can see why ObamaCare’s defenders really need to keep those subsidies. Scissors-32x32.png

Halbig's Critics Miss the Mark

In Halbig v. Burwell, the federal appellate court for the District of Columbia (“D.C. Circuit”) interpreted a clause in the Affordable Care Act (“ObamaCare”) to mean exactly what it would mean to the average reader. The provision authorizes subsidies to certain individuals purchasing health insurance through “an Exchange established by the State.” The court concluded that this meant that individuals purchasing health insurance through an exchange established by a state may receive subsidies. The court rejected the government’s argument that, based on context, the word “State” must refer to either a State or the federal government.

 

Not satisfied merely to disagree with the court’s opinion, some critics describe the court’s act of commonsense interpretation as “shamefully dishonest,” “legally laughable,” and “judicial sophistry.”Scissors-32x32.png

People Who Can Read Are “Obamacare Truthers” Now

The left has been in power so long they have completely lost both the ability to persuade people and any interest in doing so. Instead the only tools remaining in their kit are mocking and derision. So it is that we find that the left has coined a new and not very creative insult for people who believe that the Halbig plaintiffs were correct and that Obamacare, as written, confines the subsidies for the purchase of health insurance to states that have set up their own exchange. The term, of course, is “Obamacare Truther.” Scissors-32x32.png

 

The latest instance of a lefty using this derisive phrase is especially egregious since it happens to be Jonathan Cohn, who was most recently caught on tape contradicting virtually all his reporting for this entire year by saying, back in 2010, that the Halbig plaintiffs Scissors-32x32.png
