When a government engages in enslavement, under the guise of legislation and taxation, it is tyranny. Obamacare is exactly that — and more — as explained by G. Keith Smith, MD, a board-certified anesthesiologist and the co-founder of The Surgery Center of Oklahoma. In an article he wrote for the Association of American Physicians and Surgeons (AAPS), Dr. Smith points out that not only are Americans *COMPELLED* against our will to participate in Obamacare because we can’t opt out of it, the Unaffordable Care Act is a Ponzi scheme that exploits and enslaves young Americans who, under Obamacare, are *COMPELLED* to acquire and pay for health insurance (which most of them, being young and healthy, don’t need) in order to subsidize the healthcare costs of older and sicker Americans. That is why the POS in the White House has unleashed his army of brain-dead Hollyweird “celebrities” to pimp for Obamacare. Alas, too many young Americans are themselves brain-dead and eager to lend their support to the Unaffordable Care Act against their own interests. The first is found in the “News to Know” of our eNewsletter (our new Exchange Opt-Out Declaration). The second is a very important lawsuit headed to the U.S. Supreme Court to be considered for a hearing. This lawsuit makes a case that the individual and employer mandates are void due to unconstitutional processes engaged by the Democrat-led Congress. Without the mandates (and their penalties), Obamacare would be toothless. CCHF is helping to fund a “Petition for a Writ of Certiorari” for the case of Liberty University vs. Jacob Law, Secretary of the Treasury. The petition will be written by an attorney experienced in constitutional law and in making arguments to the U.S. Supreme Court. If the Court “grants Cert,” the lawsuit will be heard and a ruling will be issued. The best arguments can move the Court to hold a hearing. Our petition will make the case that the individual and employer mandates are void – unconstitutional and illegal – because the legislative process Congress used to enact Obamacare violated the U.S. Constitution’s Origination Clause (Art. 1, Sec. 7, Cl. 1) and Presentment Clause (Art. 1, Sec. 7, Cl. 2). The Presentment Clause prohibits a bill from having two versions of itself within the very same bill. But Obamacare has both the original language for the individual and employer mandates and amendments of the mandate language within the same bill, forcing Congress to vote once on essentially two versions of the same bill – the version as written with the original language and the version as written with amendments to the original language. In other words, instead of deleting the original language (delete and paste), the bill keeps the original language and later in the bill amends (deletes) it. Thus, the individual and employer mandates (and the imposed fines) should be thrown out on their ear – voided – by acknowledgement that the process of passing the Senate bill violated the U.S. Constitution. Without the mandates, Obamacare can be ignored by the American public and American businesses. Defeating Obamacare can be done. Interesting concept.....but I hope their constitutional lawyer is better than Oblunder.....and they ain't goin' anywhere, if they sue Jacob Law, Secretary of the Treasury........it's Jacob Lew... Catastrophic calamity is the catalyst for evolution. We are in the bowels of catastrophic calamity. Obamacare is the catalyst which will cause new answers to the game. As an example, Medicare was touted as the saving grace for all the older members of our community. But as the requirements on this system grew, and the players learned how to “game” the system, we saw a support GAP. Those that needed medicare found that they were still paying too much, and “gap insurance” was born. This is NOT health insurance. It is an insurance ‘tool’ that provides financial support for those payments NOT covered under the primary Health Insurance policy. In this case, Medicare. That insurance is still allowed to exist. For one, it makes a lot of money for a very powerful influence pedaling group (AARP). And two, it really is not health insurance. It only pays for those costs not covered by one’s health coverage. So, what I propose as a solution, if Obamacare cannot be exterminated, is that the primary insurance providers create a new ‘tool’ to cover the GAP between coverage (or no coverage) of Obamacare and one’s health.
