Valin Posted May 23, 2013 Share Posted May 23, 2013 NBC News Michael Isikoff 5/23/13 Attorney General Eric Holder signed off on a controversial search warrant that identified Fox News reporter James Rosen as a possible co-conspirator in violations of the Espionage Act and authorized seizure of his private emails, a law enforcement official told NBC News on Thursday. The disclosure of the attorney generals role came as President Barack Obama, in a major speech on his counterterrorism policy, said Holder had agreed to review Justice Department guidelines governing investigations that involve journalists. (Snip) Holder previously said he recused himself from the AP subpoena because he had been questioned as a witness in the underlying investigation into a leak about a foiled bomb plot in Yemen. His role in personally approving the Rosen search warrant had not been previously reported. A Justice Department spokeswoman did not immediately respond to a request for comment. The Department of Justice later issued a statement about the review of media guidelines: This review is consistent with Attorney General Holder's long-standing belief that freedom of the press is essential to our democracy," it said. "At the same time, the attorney general believes that leaks of classified information damage our national security and must be investigated using appropriate law enforcement tools. If Faux doesn't have anything to hide, why should they be afraid of a legal warrant issued? (Snip) "The Department takes seriously the First Amendment right to freedom of the press. In recognition of this, the Department took great care in deciding that a search warrant was necessary in the Kim matter, vetting the decision at the highest levels of the Department, including discussions with the Attorney General," said a department spokesman who asked not to be named. "After extensive deliberations, and after following all applicable laws, regulations and policies, the Department sought an appropriately tailored search warrant under the Privacy Protection Act. And a federal magistrate judge made an independent finding that probable cause existed to approve the search warrant. Attorney General Holder understands the concerns that have been raised by the media and has initiated a reevaluation of existing Department policies and procedures. This review will include extensive engagement with representatives of the media. The Department must strike the appropriate balance between its obligation to enforce the laws preventing leaks of classified information and First Amendment rights, and, through a new media shield law and appropriate updates to the Departments internal guidelines, we are committed to achieving that balance," the spokesman added. Rheo Posted May 24, 2013 Share Posted May 24, 2013 Obama DOJ Fought to Keep Search of Rosen Emails Secret Late on Friday, the New Yorker’s Ryan Lizza reported that the Obama administration did not merely greenlight a search warrant on Fox News reporter James Rosen’s email account – it “fought” to prevent Rosen from learning about it. Ronald C. Machen, Jr., the US attorney prosecuting former State Department advisor and alleged leaker Stephen Jin-Woo Kim, asked a judge to prevent Rosen from learning about the search and seizure of his emails. Machen wrote that emails “are commonly used by subjects or targets of the criminal investigation at issue, and the e-mail evidence derived from those compelled disclosures frequently forms the core of the Government’s evidence supporting criminal charges.” Machen said that such secrecy should continue indefinitely, since “some investigations are continued for many years because, while the evidence is not yet sufficient to bring charges, it is sufficient to have identified criminal subjects and/or criminal activity serious enough to justify continuation of the investigation.” Not only did Machen want to ensure that the news of the search didn’t get out via the government, he asked that Google be ordered not to let Rosen know about the email seizures. The New York Times reports the Department of Justice investigated national security leaks given to Times reporter David Sanger over his story last year about the Stuxnet virus by pulling all the email and phone records of government officials who communicated with the reporter. . . . The Times Ethan Bronner, Charlie Savage and Scott Shane report the FBI requested for any phone and email logs from the White House, the Defense Department and other intelligence agencies that showed any contact between employees and Sanger. It does not appear they went so far as to seize Sangers telephone records or emails, as they did with the Associates Press and Fox News reporter James Rosen. They at least got creative this time. Instead of looking at his communication records, they looked at the communications between him and every government employee by looking on their end.
