Late yesterday afternoon, the Seventh Circuit granted an emergency injunction against the HHS mandate — preventing its enforcement against an Illinois business and its owners. My colleagues at the ACLJ represent Korte & Luitjohan Contractors, Inc., a family-owned, full-service construction contractor. The company is located in Highland, Ill., and employs about 90 workers.

The brief opinion is worth a read in its entirety, but two parts stand out. First, the court disagreed with the Tenth Circuit’s recent decision rejecting Hobby Lobby’s request for a similar injunction. In a key paragraph the court stated: Scissors-32x32.png

Federal judge halts Obama birth-control policy for Domino's Pizza founder

A federal judge has ordered a temporary halt on the Obama administration's birth-control coverage policy for Tom Monaghan, the Catholic billionaire who founded Domino's Pizza.

Federal District Court Judge Lawrence P. Zatkoff issued the decision Sunday, less than two days before the policy would have taken effect and exposed Monaghan to fines for non-compliance.

 

"Plaintiff has shown that abiding by the mandate will substantially burden his exercise of religion," Zatkoff wrote.

"The government has failed to satisfy its burden of showing that its actions were narrowly tailored to serve a compelling interest.

Monaghan also founded Ave Maria University, a Catholic college in Florida, and Legatus, a group of Catholic business leaders. Both organizations have already filed suit over the mandate. Planned Parenthood can be kicked out of program, judge rules

Texas can exclude Planned Parenthood from the Women’s Health Program when the state begins running the contraception and preventive care initiative on Tuesday, a judge ruled today.

 

Visiting Judge Gary Harger denied the organization’s request for a temporary restraining order that would have forced Texas to allow Planned Parenthood to remain in the program, which provides contraceptive and preventive health care to about 110,000 low-income women a year.

 

 

“We are pleased the court rejected Planned Parenthood’s latest attempt to skirt state law,” said Lauren Bean, a spokesman for Attorney General Greg Abbott. “The Texas Attorney General’s office will continue to defend the Texas Legislature’s decision to prohibit Scissors-32x32.png
