Rahm Emanuel was thrown off the ballot for mayor of Chicago today by an appellate court panel, a stunning blow to the fund-raising leader in the race.

An appellate panel ruled 2-1 that Emanuel did not meet the residency standard to run for mayor.

Appellate judges Thomas Hoffman and Shelvin Louise Marie Hall ruled against Emanuel. Justice Bertina Lampkin voted in favor of keeping President Obama’s former chief of staff on the Feb. 22 ballot.

“It’s a surprise,” said Kevin Forde, the attorney who argued on Emanuel’s behalf.

Emanuel’s attorneys are expected to use Lampkin’s dissenting opinion to appeal the case to the Illinois Supreme Court.

In today’s ruling, Hoffman wrote: “We ... order that the candidate’s name be excluded (or if, necessary, be removed) from the ballot from Chicago’s Feb. 22, 2011.”

Emanuel had won two previous rulings — by the Chicago Board of Election Commissioners and a Cook County judge. The case was appealed to the appellate court, which handed down the ruling before noon Monday.

Opponents have argued Emanuel is not a resident of Chicago because he rented out his North Side home while serving as chief of staff to Obama. The renter —Rob Halpin — refused to allow Emanuel to move back in after Mayor Daley’s announcement last year that he would not seek re-election. Halpin briefly ran for mayor himself.

Being from Louisiana and having lived for a time in New Orleans, I've seen corruption, but it wasn't till I spent about 3 weeks in Chicago that I saw REAL corruption. By the time I left, I couldn't wait to get on the plane out of O'Hare fast enough.

Having also experienced both I can say that the difference is that in Louisiana politics is a sport.....in Illinois it is a blood sport.

Rahm Emanuel faces a double-barreled legal problem just days before voting begins in the Chicago mayoral race — stopping election officials from printing ballots without his name and persuading the state's highest court to restore his candidacy.

 

Hours after an Appellate Court decision removed him from the Feb. 22 election, lawyers for Emanuel late Monday asked the Illinois Supreme Court to stay that ruling while they prepare an appeal to make the case that Chicagoans should have a chance to vote for the former White House chief of staff.

 

Though the issue of whether Emanuel properly met a one-year residency requirement to run for mayor was always destined to come before the high court, he now goes to that seven-member forum in a weakened posture, carrying the weight of trying to prove the Appellate Court wrong. Traditionally, the state's highest court has shied away from local candidacy and residency election issues.

 

"We're ready to go on a very fast track," Emanuel attorney Kevin Forde said.

 

In its first filing with the Supreme Court, the Emanuel lawyers suggested an expedited schedule promising they could file their arguments by Wednesday. But the high court first has to decide whether to hear the case at all. If it declines, Emanuel's bid for mayor effectively comes to an end.snip

Oh, piffle! MrChick predicted the Illinois Supreme Court would do this when he first heard the Appellate court ruling. I got my hopes up, but knew he was probably right. Sure enough . . . :(

Depending on what they rule. They just put a stay on the previous ruling, so his name can go on the ballot...then they rule to see if it can stay there....then I guess they just say, pay no attention to that man's name on the ballot. :blink:

He made the statement yesterday that if they let him vote there the last year he must be a resident and he must be eligible for office. By those standards, a lot of dead people should be eligible for mayor (well, of course we do not know for certain whether Daly has been dead or not for a long time :P )

The courts have just ruled that his name will be printed on the upcoming ballots. If he wins, how are they going to then rule that he is ineligible? Major win for him to get on the printed ballot.

It has not been ruled he will stay on the ballot. Only ruled that any ballots printed between now and when/if the SC decides to hear/rule on the case should have his name on it. If he does not succeed in winning appeal then his name would have to be removed/crossed out.

Oh, OK. Will the courts be able to come to a decision before Feb 22? Wouldn't love to be able to hear the tapes the FBI is recording now? And he still has Blago's trial to attend. This could all go down as the strangest election even for Chicago.

The Illinois Supreme Court has agreed to hear the appeal of a court decision that knocked Rahm Emanuel out of the mayoral race.

 

So this is much better news for him. They will hear the appeal. They could have just "punted" and left it alone.
