A California judge ruled that former President Donald Trump’s lawyer John Eastman should be disbarred for an alleged attempt to subvert the 2020 election results.

State Bar Court of California Judge Yvette Roland announced her ruling Wednesday. The former Trump lawyer was accused of 11 disciplinary charges in California’s bar court, ten of which the judge found he was culpable for violating.

“In view of the circumstances surrounding Eastman’s misconduct and balancing the aggravation and mitigation, the court recommends that Eastman be disbarred,” Roland wrote in her decision. The recommendation will now go to the California Supreme Court for a final ruling.

Roland’s ruling marks a defeat for Eastman, though she did side with him on one of his 11 counts.

The state bar accused Eastman of moral turpitude over a speech he gave on Jan. 6 at the Ellipse outside the White House, tying it to the riot later in the day, but the judge dismissed the count after holding the bar “presented no evidence to show that Eastman’s statements contributed to the assault on the Capitol.”:snip:

The heroic sacrifice of John Eastman

An open letter from Eastman's children and a call to action.

Tucker Carlson hosted Dr. John Eastman on Fox News on June 27, 2022, shortly after the FBI unlawfully seized Eastman’s phone, which contained attorney-client privileged information. After Tucker showed the video of armed FBI agents frisking Eastman, he scoffed: “Disgraceful. Wearing his little mask. ‘Put your hands up,’ as if Eastman is a threat. He’s not. He’s a lawyer.”

On this rare occasion, Tucker was wrong. John Eastman is the greatest threat to the far left’s regime of anarcho-tyranny. This regime unleashes violent criminals on our streets, extends bail to serial rapists, and releases illegal aliens who commit criminal acts. But if a conservative lawyer dares to provide legal counsel to a sitting U.S. president, his livelihood and reputation will be destroyed with the full force of government and other institutions infected by the “woke” virus.

This, of course, is the stated goal of the 65 Project, a group of left-wing activists dedicated to destroying regime critics through the mechanisms of lawfare: Make patriotic lawyers “toxic in their communities.”

For those new to the Eastman saga, this case study in lawfare began in the public eye on January 6, 2021. Months before, President Donald Trump had sought Eastman’s counsel on cases dealing with election illegalities and fraud.

Eastman became a widely recognized public figure after his speech at the Ellipse on January 6 and for authoring what became known as the “Eastman memos,” internal brainstorming documents in which he laid out numerous scenarios for consideration in efforts to combat the massive instances of illegality that his investigations had revealed in the 2020 election.:snip:

Lawfare Against John Eastman

The regime has lost all perspective and decency in its war on its perceived enemies.

Dr. John Eastman is a patriot, a constitutional scholar, a lawyer, a husband, and a father. He is our friend, colleague, and fellow board member of the Claremont Institute, who has spent his life defending the principles upon which this great nation was founded. After a ten week travesty of a trial, a California Bar Court judge, seeking to criminalize disagreements in constitutional interpretation, recommended that John should lose his license to practice law in California.

The term “lawfare” has become part of the American vernacular in the past few years. It means the manipulation and corruption of the legal system to gain political advantage and attack and destroy one’s political opponents. The most famous example of lawfare is, of course, the shocking abuse of the U.S. Department of Justice, the Attorney General’s office in the state of New York, and the District Attorney’s office in Fulton County Georgia in an attempt to destroy the current Republican candidate for the presidency, Donald J. Trump. But the assault on Trump is just the most widely publicized example of this evil practice, which is destroying the rule of law in America.

Anyone who dares to oppose the reigning progressive regime, at any level and in any way, is a potential target of this lawfare. Especially targeted are those who dared to raise any question about the legality of the 2020 election. Prominent among these is John Eastman.:snip:

John Eastman and the Left’s War on the Legal Profession

John Eastman is a lawyer, a legal scholar, and a friend.

I got to know John—a former clerk to Supreme Court Justice Clarence Thomas, candidate for California attorney general, and dean of Chapman University School of Law—during my weeklong 2018 legal fellowship with the Claremont Institute, which he oversaw. We have stayed in touch and done at least one event together for Claremont since that time.

Unfortunately, since the 2020 presidential election, John has been put through the wringer more than just about anyone in American public life.

He was forced to retire from the law school where he was a longtime constitutional law professor and even dean. He was let go by the University of Colorado’s Benson Center for Western Civilization, where he was a visiting scholar. Armed Stasi—sorry, FBI—agents accosted him in a parking lot and seized his phone without a warrant. He has been suspended from academic conferences and lost board seats. He and his wife have endured death threats, spikes in their driveway, and threatening graffiti in their neighborhood. He has been debanked by Bank of America and the USAA. He is being criminally prosecuted by scandal-ridden Fulton County, Georgia, District Attorney Fani Willis. And last week, State Bar Court of California Judge Yvette Roland devoted 128 pages to explaining why he should lose his law license.

All this because John had the chutzpah to do what every law school student is taught to do in legal ethics class: defend and zealously advocate for one’s client, no matter how unpopular or even disreputable that client may be. In this case, John’s unpopular client was a high-profile one: former President Donald Trump.:snip:

Trump Election Lawyer John Eastman Says He Was Disbarred For Free Speech

California Bar Disciplinary Judge Yvette Roland disbarred Donald Trump’s former attorney and constitutional legal scholar John Eastman.

She issued a 128-page opinion on March 27, almost four months after she’d received the parties’ closing written statements.

Eastman posted an article on his Substack about the ruling, stating that he would follow up with more articles analyzing the decision in depth. He said Roland, who donated to Democrats while serving on the bench, disbarred him since she claimed he “made misrepresentations of hotly disputed facts and unresolved questions of constitutional law in my representation of former President Trump and his challenges to the illegality of the 2020 election, and because I also made those claims in public speeches, writings, and media appearances in which I highlighted illegality in the election (all of which is constitutionally protected speech).”

A nationally renowned constitutional expert told The Arizona Sun Times that he or she believed Roland took so long because she was receiving assistance writing the opinion from progressive legal activists. The expert pointed out that Roland frequently appeared confused during the trial, sometimes not sure what part of the trial they were at and unaware of key facts such as that Congress amended the Electoral Count Act in 2022 to prohibit the vice president from having substantial authority to accept or reject electoral slates.:snip:

‘Rather Despicable’: John Eastman Speaks Out After Bank Of America, USAA Shut Down His Accounts

One of the left’s biggest political targets recently found himself “de-banked” with no warning and little avenue for recourse, the Daily Caller has learned.

John Eastman, once an attorney for former President Donald Trump, was de-banked twice in the span of several months by two prominent financial institutions, Bank of America and USAA, he told the Daily Caller. His accounts were closed as he faced substantial backlash for his work advising Trump around the time of the 2020 election.:snip:
