Justice Dept. to appeal decision lifting mask mandate on planes, trains if CDC deems rule necessary The Justice Department is not asking for a stay of the lower court decision, meaning passengers will continue to be able to fly without face coverings.

A campaign issue/promise the Republicans could make is that if they win back both houses - they'll push for something similar to the recent change in PA.  Since last May, emergency decrees (by the executive branch) have a set time limit without re-authorization by the legislative branch.  That way, a true emergency can be met expeditiously, but can't be extended without oversight by the People's elected representatives.
