"The Department continues to believe that the order requiring masking in the transportation corridor is a valid exercise of the authority Congress has given CDC to protect the public health," the Justice Department said in a statement. "That is an important authority the Department will continue to work to preserve."

A campaign issue/promise the Republicans could make is that if they win back both houses - they'll push for something similar to the recent change in PA.  Since last May, emergency decrees (by the executive branch) have a set time limit without re-authorization by the legislative branch.  That way, a true emergency can be met expeditiously, but can't be extended without oversight by the People's elected representatives.
