Evidence request by Flynn's lawyer seeks to expose Clinton-FBI alliance in Russia probe

The new attorney for retired Army Gen. Michael Flynn is putting the scandal-marred Trump-Russia investigation on trial in a bid to make federal prosecutors produce more evidence.

In a court filing, Sidney Powell accused former special counsel Robert Mueller’s staff of being part of a broad “illicit operation” by FBI agents and operatives of 2016 Democratic presidential nominee Hillary Clinton to spread and use a Democratic Party dossier filled with false allegations against President Trump.

Ms. Powell said Flynn, who pleaded guilty in December 2017 to lying to FBI agents, was caught up in this conspiracy. She wants U.S. District Judge Emmet G. Sullivan to order prosecutors to turn over more evidence so she can determine how the Clinton-FBI alliance affected Flynn.

One of the FBI agents who interviewed Flynn at the White House is fired agent Peter Strzok. He headed the Trump-Russia probe, used the dossier and vowed in a text message to “stop” Mr. Trump.:snip:

What Happened During Flynn Lawyer’s Secret Meeting With Judge This Week?

The question is whether Michael Flynn was affected by efforts to get Trump, and whether Judge Sullivan will keep him from reviewing the evidence that could prove prosecutorial misconduct.

On Thursday, two docket entries in the criminal case against Michael Flynn provided a roadmap to the next steps in the case that took a surprise turn last week. As I reported earlier this week, while Americans prepared for the long Labor Day weekend, lawyer Sidney Powell, who had taken over Flynn’s defense in June, hit federal prosecutors with a motion to compel evidence and a request for sanctions for prosecutorial misconduct.

In her motion, Powell charged that government attorneys withheld potentially exculpatory evidence from Flynn, whom had pleaded guilty in late 2017 to lying to FBI agents. In a status report filed the same day, Powell also complained that the government had refused to grant her a security clearance to allow her to review pertinent evidence, and she sought presiding judge Emmett Sullivan’s intervention.

Yesterday, Judge Sullivan “held an ex parte and sealed hearing with Mr. Flynn and defense counsel to consider Mr. Flynn’s request for the Court’s intervention on counsel’s request for security clearances.” An ex parte hearing is one in which one or more parties are absent, which here would mean the prosecutors did not participate in the hearing. Because the hearing was sealed, a transcript is not publicly available, and Powell is prohibited from commenting on the proceedings.:snip:

Michael Flynn’s Legal Team Lists 40 Documents It Says Will Vindicate Former National Security Adviser

  • Michael Flynn’s lawyers submitted a list of 40 government records they say will vindicate the former national security adviser.
  • Sidney Powell, the lead attorney for Flynn, wants prosecutors to provide documents related to FBI informant Stefan Halper and the infamous Steele dossier and regarding a media leak to The Washington Post in January 2017.
  • Powell also said Justice Department memos exist that indicate Flynn was exonerated early in the Russia probe of being a Kremlin asset.:snip:

Rod Rosenstein Authorized Mueller To Investigate Flynn’s Son, Sidney Powell Says

A lawyer for Michael Flynn said Tuesday former Deputy Attorney General Rod Rosenstein authorized special counsel Robert Mueller to investigate Flynn’s son, Michael Flynn Jr.

Sidney Powell, Flynn’s lawyer, made the revelation in an interview with Fox News’s Sean Hannity while discussing developments in Flynn’s case. Powell argued in federal court Tuesday that charges against the former national security adviser should be dismissed due to “egregious misconduct” on the part of prosecutors.

“We know that Mr. Mueller got a letter from Mr. Rosenstein that allowed him to target Michael Flynn Jr., and there was significant pressure to enter a guilty plea while they were hiding all the evidence that showed he had not been an agent of Russia, that there were no Logan Act violations,” Powell told Hannity.

Hannity asked Powell about the possibility that Flynn took a plea deal in order to protect his son from being prosecuted. Powell did not confirm Hannity’s scenario, but suggested it was possible.

Sidney Powell’s Latest Motion In Michael Flynn’s Case Is A Russiagate Bombshell

On Wednesday, the previously sealed Motion to Compel filed against federal prosecutors in the Michael Flynn case was made public with only minor redactions. Just the day before, during a hearing before federal judge Emmet Sullivan, Flynn’s attorney, Sidney Powell, had highlighted some of the evidence prosecutors withheld from her defense team. Yesterday’s filing expanded exponentially on the areas of evidence Powell seeks and lays bare Powell’s bigger plan moving forward: to expose the breadth and depth of SpyGate and how flaying Flynn lay at the heart of the soft coup attempt.

In her Motion to Compel, Powell catalogued 40 categories of evidence the government has refused to turn over. She seeks a court order requiring federal prosecutors to provide the withheld evidence under Brady and its progeny. Bradyand its offshoots require prosecutors to disclose material exculpatory and impeachment evidence to the defense team. And, as Judge Sullivan made clear during Tuesday’s hearing, that duty exists even though Flynn had already pleaded guilty and even though he had agreed that the government would not be required to provide him with further evidence.:snip:

New Evidence Suggests Prosecutors Pressured Michael Flynn To Lie

The evidence of prosecutorial misconduct in the Michael Flynn case continues to grow. And with each new court filing by Flynn’s new criminal defense attorney, Sidney Powell, the public learns more about the events leading up to Flynn’s guilty plea and the government’s manipulation of Trump’s former national security advisor.

The latest development came on September 30, when Powell filed a supplement status report summarizing the outcome of the criminal case against Flynn’s former Flynn Intel Group (FIG) partner, Bijan Rafiekian. Presiding Judge Emmett Sullivan had requested the parties provide the court a statement concerning the impact of the government’s decision not to call Flynn as a witness in that case. That provided Powell an opening to inform Judge Sullivan that the prosecution’s case against Rafiekian had been tossed.:snip:
