It becomes law with the Republican governor's signature. Here's hope this catches on across the country. Civil asset forfeiture looks more like a criminal enterprise than criminal justice. Under civil asset forfeiture laws, police and other law enforcement authorities are free to seize private property without charging the owner with any crime. It has truly grown into a racket. The New Mexico legislation "abolishes this practice, and now before police may seize an individual's property they must convict that person of a crime and prove that the property being seized was used in the commission of that crime," reports the Jurist, a Web-based legal news and legal research service. "Additionally, the bill directs any monetary gains from the seizure of property to the state's general fund instead of the police budget.
