Tensions exploded Thursday during a frenetic hearing to determine whether Fulton County’s district attorney’s office should be disqualified from continuing its 2020 election interference prosecution of former President Trump and his allies due to a relationship between top prosecutors on the case. 

Fulton County District Attorney Fani Willis (D) herself suddenly took the witness stand to defend her once romantic relationship with special prosecutor Nathan Wade, clashing face-to-face with defense attorneys whom she and Wade both accused of lying.

Willis calls allegations a ‘lie’

After allegations of a romance between the prosecutors surfaced, the district attorney’s office stayed silent for weeks. But on Thursday, Willis took the witness stand with gloves up.

Willis, Wade stand firm on relationship timeline

Both Willis and Wade testified that their relationship began in early 2022, some time between February and April but both struggled when asked for precise dates of when the relationship started and ended.

Despite their agreement, the relationship timeline presented by Willis and Wade was imperiled by testimony from one of Willis’s former friends.

At the heart of Roman’s disqualification motion is whether Willis hired Wade while they had a romantic relationship and has since financially benefited from his employment.

Wade disputes defense claim he lied in divorce filings

On Monday, Merchant , who first unearthed the romantic allegations between Willis and Wadein court filings, claimed Wade previously said in divorce documents, under oath, that he had no outside relationship during his marriage —  a direct contradiction to the affidavit he filed earlier this month acknowledging his relationship with Willis.

Below are some of the top takeaways from the first day of the hearing.

Willis reimbursed Wade in cash, according to their testimonies.

Bank statements and corroborating witness testimonies revealed that Willis and Wade vacationed together at least as early as 2022 to places such as Aruba, Belize, and Napa Valley and that they took day trips and dined together. One of Roman’s key claims is that Willis, who has been using Fulton County funds to pay Wade a hefty hourly rate, financially benefited from the relationship.

Willis and Wade were grilled on when their romantic relationship began.

Merchant has been claiming she has proof that Wade lied on a sworn affidavit he submitted to the court this month by saying he and Willis did not become romantically involved until after November 2021, when Willis appointed him to the Trump case.

Willis accuses an attorney of lying, prompting the judge to admonish Willis

When Willis first entered the courtroom, she announced that she would no longer fight the subpoena Merchant had issued her. She said she was so “anxious” to have a conversation with Merchant that she “ran” to the hearing room. Once taking the stand, Willis immediately began taking shots at the attorney.

McAfee scolded Willis and called for a brief recess and later warned her two more times to cease her outbreaks and long-winded responses.

Willis is set to take the stand to finish testifying Friday morning.

Former law firm partner and divorce attorney Terrance Bradley testified under oath Tuesday regarding what he knew about Georgia prosecutor Fani Willis and special prosector Nathan Wade's personal relationship. Bradley took the stand after Judge Scott McAfee determined Bradley couldn't claim attorney-client privilege.

Bradley, when pressed under oath, said he couldn't recall several details and timelines about conversations he had with former client Nathan Wade about Wade's romantic relationship with Fani Willis.

Defense attorney Ashleigh Merchant at one point referenced text messages between her and Bradley in which she had asked Bradley if he thought the relationship started before Willis hired Wade in 2021. Bradley responded "absolutely" in the text exchange.

But in court Tuesday, Bradley said he was "speculating" in those comments.

After today’s testimony from Terrence Bradley, the disqualification of Fulton County District Attorney Fani Willis and Special Counsel Nathan Wade is still up in the air.

Last night, Fulton County Judge Scott McAfee ruled that Terrence Bradley (the former law partner of Wade who represented Wade during his divorce) can testify concerning his knowledge of the romantic relationship between District Attorney Fani Willis and Special Prosecutor Nathan Wade. Judge McAfee made this ruling after conducing a private conference with Bradley and Bradley’s attorney.

If you recall, Bradley largely relied on attorney-client privilege to refuse to answer questions regarding his personal knowledge of the Willis/Wade relationship. Judge McAfee made the determination that, at times, Bradley misapplied the attorney-client privilege during his previous testimony, and that at least some of Bradley’s knowledge of the affair was outside the scope of that privilege. (Judge McAfee didn’t answer the question of whether attorney-client privilege could be pierced due to potential fraud on the Court by Wade.)

Judge McAfee opened today’s hearing with his ruling on the attorney-client privilege issue, stating after considering Bradley’s testimony and in camera, neither Wade or Bradley “met their burden to establish the attorney-client privilege applied” with respect to the Wade/Willis relationship.

This caused for some optimism.
