President Obama didn’t keep Congress entirely in the dark in the lead-up to exchanging five Taliban leaders for captive U.S. Army sergeant Bowe Bergdahl, he just didn’t tell Republican leadership.

 

Obama did inform Senate majority leader Harry Reid (D., Nev.) that the exchange was imminent. “It must have been either the day before or the day of. I don’t remember for sure,” Reid told Politico.

The Defense Department told Boehner of the exchange after it took place. “In that call, according to a GOP aide, the DoD official proactively acknowledged that the exchange was ‘inconsistent’ with the law,” ABC reports. The president is legally required to notify Congress 30 days before releasing a prisoner from Guantanamo Bay.

 

A White House official apologized to Senate Intelligence Committee chairwoman Dianne Feinstein (D., Calif.) for failing to tell her of the deal.

Focus on the Special Forces soldiers, not the Taliban or Bowe Bergdahl.

The Taliban have released a video of Bowe Bergdahl being released to U.S. Special Forces soldiers who arrived by helicopter. Five high ranking Taliban members were released from Gitmo in exchange.

On Sunday, enroute from Afghanistan to Singapore SECDEF Hagel, commenting on Bergdahl told reporters, “Again I remind you, this was a prisoner of war exchange. He was a prisoner.”

 

A prisoner of war exchange? So the Gitmo scum are prisoners of war? I thought the argument from the left has been that they were simply detainees, to be tried in civilian courts. Which is it?

And Snackeater, what nations exchanged prisoners of war? I thought prisoners of war were prisoners of conflict between nations.

 

Also, now we have something else to think about. Anyone think that the Afghan CIA station chief's identity was outed because he opposed the swap?

Was President Obama’s exchange of five Gitmo detainees for Army Sgt. Bowe Bergdahl illegal? Some conservatives — most notably the editors of the Wall Street Journal — are defending the decision as a proper exercise of Obama’s Commander-in-Chief power. I am not so sure. In fact, rather than a sign of strength, I think President Obama’s decision will ultimately weaken the office over the long run.

 

I think that a blanket legislative ban on the release of Guantanamo Bay prisoners would violate the President’s authority as Commander-in-Chief to control prisoners of war. Control of prisoners of war has long remained an important aspect of tactical and operational decisions on the battlefield; their detention and release can influence the morale of the enemy and their treatment of own soldiers. I make this case in greater detail in my 2006 book, War by Other Means, where I argued that President Bush should have had full constitutional authority as Commander-in-Chief to set policy on the capture and detention of al Qaeda operatives.

 

On the other hand, I think that Congress can use its spending power to decisively influence military policy. It could, for example, have closed Gitmo long ago by refusing to fund it. It can also prevent the transfer or release of prisoners by refusing to pay for it. In fact, it has done this for transfers of prisoners to the continental United States. I believe that Congress’s power of the purse is plenary and that the President cannot override it, even with the Commander-in-Chief power.

A celebration in Bowe Bergdahl's hometown of Hailey, Idaho, planned for later this month has been cancelled in the wake of a firestorm of controversy over how the Army sergeant wound up as a Taliban captive.

In the Wednesday statement, the town said they had received about "100 correspondences" per day on the issue, both positive and negative.

 

Hailey officials say they aren't cancelling because of any threat, but because of the numbers of people that might have turned up.

 

"The organizers and Hailey expect a significant increase in attendance to this event, by people who both want to support or protest against it," they said. "In the interest of public safety, the event will be cancelled. Hailey, a town of 8,000, does not have the infrastructure to support an event of the size this could become."

The Oct. 3, 2009 battle at Combat Outpost Keating, near the town of Kamdesh in Nuristan province, lasted more than 12 hours and earned two Army staff sergeants the Medal of Honor, the highest award for bravery the Pentagon can bestow on a warrior.

 

But multiple sources including a well-placed Pentagon official told MailOnline that the bloodshed was far worse than it needed to be, and blamed the months-long shuffling of American military resources all across the Afghanistan-Pakistan border region after Bergdahl walked away from his post on June 30 of that year.

 

‘The COP Keating battle was so deadly because ISAF numbers were so low,’ a Pentagon official said, referring to the International Security Assistance Force, the generic term for the U.S.-led coalition fighters that included small numbers of soldiers from Afghanistan, Latvia and other nations.

 

‘And that was because so many U.S. troops were off searching for Bergdahl.’

 

The official spoke on condition of anonymity because he is not authorized to comment publicly.

So last night I talked with someone who knows the inside story of the Obama White House. I have to keep the person's identity secret but he told me that the President has come to the conclusion that his administration is not, not going to accomplish its goals.

 

He knows the economy is not going to turn around. He no knows Obamacare is not going to be popular. And he understands that his job approval rating will likely remain below 50 percent. Therefore, according to this guy, the President has concluded that public opinion really doesn't matter anymore. Thus, Mr. Obama is going to do what he wants to do and the consequences be damned. I believe that assessment is accurate.
