Just when you thought the lawlessness of the most lawless administration in history couldn't get worse, the Department of Justice files another legal brief.

 

In response to a class action lawsuit by as many as 3,500 ready-to-hire air traffic controller applicants whose names were "purged" so the Federal Aviation Administration could hire based on race, federal lawyers asserted that the administration is immune from liability for denying constitutional equal protection because of sovereign immunity. In other words, they claim protection by the legal maxim rex non potest peccare, which means, "the king can do no wrong."

 

Beginning in 1991, the FAA collaborated with universities and colleges to create 36 accredited degree programs in diverse Collegiate Training Initiative schools. Then, the FAA hired those with CTI program degrees, references from CTI administrators and "well qualified" rankings on the challenging Air Traffic Selection and Training exam — a validated, proctored, eight-hour, computer-based test.

 

In 2013, however, to achieve racial diversity — notwithstanding that nearly 12 percent of those attending CTI programs were African Americans — the FAA abandoned that program, "purged" its files of the 2,000 to 3,500 CTI graduates, and began hiring any English-speaking citizen with a high school diploma, while screening new applicants to ensure their racial "diversity."

 

In late December 2015, Mountain States Legal Foundation responded with a class action lawsuit in Arizona federal district court on behalf of those who satisfied the FAA's time-tested and rigorous tests for prospective air traffic controllers, but whose names were purged after the FAA announced hiring plans favorable to minorities. The lawsuit charges violation of the equal protection component of the due process clause of the Fifth Amendment and Title VII of the Civil Rights Act of 1964.

 

The class is represented by Andrew Brigida, who holds two B.S. aviation degrees from Arizona State University and scored 100 percent on the Air Traffic Selection and Training exam. Mountain States Legal Foundation filed an amended complaint in April 2016 and a second amended complaint in August 2016, following congressional action that did nothing to remediate the constitutional and statutory injuries suffered by its clients.

 

That is when federal lawyers responded that their clients were like "kings."

 

Everyone is familiar with William Blackstone's famous aphorism, "That the king can do no wrong, is a necessary and fundamental principle of the English constitution." But what does that have to do with us on this side of the Atlantic Ocean, we who revolted against a "God-King" with the words "all men are created equal," broke free and created a constitutional Republic?

 

As it turns out, precious little. In 1996, Justice John Paul Stevens wrote that sovereign immunity is a judge-made doctrine that has been "thoroughly discredited" because it is founded on the notion "that a divinely ordained monarch 'can do no wrong.'"

The Butterfly Effect principle simply states that, given enough time, whatever event, no matter how small, can and will have tremendous reverberations into the future. And when talking about past disasters, natural or otherwise, we always have to keep in mind that, even though devastating, they are part of what brought us here in the first place. Without them the world and everything in it would have taken a totally different turn, ending up completely different than it is today. The further back in time any particular event takes place, the more indirect influence it has on the present and future, altering them beyond recognition.

 

We may try to speculate on how things would have turned out if any particular disaster from our past didn’t happen, but the variables are so small and infinitely numerous, that we may never know the right answer. Similar to weather prediction (which is looking into the future, by the way), we can only make our best guess with the limited information we have. With this being said, let’s take a look at 10 natural disasters from our past, and maybe later imagine how the world would have looked like without them.

With cartridge accumulations reaching two feet or more in some areas, experts say Chicago is on track for the highest annual ammunition-depth total on record.

 

CHICAGO—Promising that every effort would be made to limit the impact on residents’ day-to-day lives, Chicago officials announced Wednesday that a fleet of plows was working around the clock to clear more than 18 inches of fresh bullet casings that had blanketed the metropolitan area overnight.

Sources at the city’s Department of Streets and Sanitation confirmed that over 250 ammunition-removal vehicles had been deployed to deal with the knee-deep layer of spent cartridges, which have been steadily accumulating on Chicago’s streets, alleys, and pedestrian walkways since the previous evening.

“Our crews have been out there all night trying to make our roadways passable, but given how quickly the handgun and semi-automatic shells have piled up, it’s going to take some time,” DSS commissioner Charles L. Williams told reporters, thanking the public for its patience while crews made their way across the stricken municipality. “We’re making good headway, but as you can imagine, it’s not an easy job, especially with casings continuing to fall throughout the city.”

“So unless you have an emergency, we’re urging all citizens to stay put for the time being,” he added. “Right now, it’s just not safe to be out in such treacherous conditions.”

Williams stated that as casing levels surpassed 12 inches, scores of extra workers from outside the city were called in to help keep pace with the buildup. In addition, numerous dump truck crews have reportedly been tasked with carting off entire trailers full of cartridges from the hardest-hit areas and depositing them in nearby landfills before circling back to pick up more.

McHenry County authorities confirmed Monday that Robert I. Sherman -- the famous and controversial atheist, activist, aviator and occasional political candidate -- died when his plane crashed into a field near Marengo over the weekend.
