Judge Barry Williams is expected to release bench verdict Thursday

 

Thursday morning trial Judge Barry Williams is expected to release his bench verdict in the “Freddie Gray” trial of van driver Officer Caesar Goodson. Officer Goodson is charged with murder, multiple counts of manslaughter, second-degree assault, misconduct in office and reckless endangerment.

 

Goodson is the third of six charged officers to be tried in the death of Freddie Gray while in police custody. The jury trial of Officer William Porter ended in a hung jury, and Porter is scheduled to be re-tried. The bench trial of Officer Edward Nero ended in an acquittal. As was the case with Nero, Goodson also elected to have a bench trial.

 

The prosecution in all these cases has put forth three distinct theories of criminal liability for the charged officers: (1) Murder by failure to seatbelt; (2) Murder by failure to provide prompt medical care; (3) Murder by “rough ride.” Scissors-32x32.png

Baltimore Sun editorial board calls for Mosby to reconsider “Freddie Gray” trials

Just a quick post here to add some additional insight into the acquittal of Office Caesar Goodson, first from an experienced trial attorney in Baltimore, then from two of the Baltimore Sun reporters who have most intensively covered these “Freddie Gray” trials, and finally an editorial from the Baltimore Sun editorial board urging Mosby to reconsider these “Freddie Gray” trials.

Will Marilyn Mosby See the Light?

State’s Attorney Marilyn Mosby must be grateful for the gag order that prevents her from talking about the Freddie Gray case. So far, her office has tried three of the six officers accused in Gray’s death, resulting in two acquittals and one hung jury. What a relief it must be to not face reporters after yet another rebuke. On Thursday, Officer Caesar Goodson — who drove the police transport van in which Gray suffered his fatal injury — was acquitted of all charges after a bench trial before Circuit Judge Barry Williams.

 

And Judge Williams didn’t merely acquit Goodson. In the verdict he handed down, he eviscerated the State’s case against Goodson and, by extension, did so to the cases yet to be tried. (Officer William Porter, the first of the six to go to trial, is scheduled to be retried after a jury failed to reach a unanimous verdict. Officer Edward Nero was acquitted in a bench trial last month.) As to every count against Goodson, Williams said the State had failed to meet its burden, citing the paucity or utter lack of incriminating evidence. Given his rationale, it’s a wonder the judge did not grant the defense’s motion for acquittal at the conclusion of the State’s case. Scissors-32x32.png
