Two legal experts tell Breitbart News Hillary Clinton and the Clinton Foundation could be in legal peril for violating United States statutes, as found in 18 U.S. Code § 201 – Bribery of public officials and witnesses.

 

When asked if the donations to the Clinton Foundation by defense contractors including Boeing (which subsequently received State Department approval of sales of their products to foreign governments) constituted a violation of domestic bribery statues, Law School Professor and Foreign Corrupt Practices Act (FCPA) expert Michael Koehler tells Breitbart News, “I’ll answer that question by quoting a former law professor who was fond of saying ‘if it walks like a duck and quacks like a duck chances are it is a duck'”

 

Former Assistant U.S. Attorney for the Southern District of New York Andy McCarthy thinks there’s enough evidence for the FBI and DOJ to launch an investigation into whether Hillary Clinton broke federal statutes that prohibit the bribery of public officials.

 

“There is certainly a reasonable basis for federal agents and prosecutors to investigate whether there was an understanding that Secretary Clinton would be influenced in the performance of her official duties by lavish donations to her family foundation, and, indeed, that the Clinton Foundation was operated as a racketeering enterprise,” McCarthy tells Breitbart News.

 

“This is the theory on which the Justice Department has proceeded in the prosecution of Senator Sen. Robert Menendez (D-NJ)— in fact, the main difference between the two cases may be that the staggering sums of money that were poured into the Clinton Foundation by supplicants who benefited from Hillary Clinton’s stewardship of the State Department dwarf the amounts involved in the Menendez indictment,” McCarthy continues.

 

“Given that Congress’s array of campaign finance laws are designed to prevent precisely what the Clinton Foundation has wrought — namely, the appearance of political influence on sales — one would think the FBI and the Justice Department would be obliged to investigate,” McCarthy concludes.

Holder's Justice Dept is in charge of the FBI. Does anyone think he will allow them to even think about investigating the Pride of the Democrat's?

 

Ooops, forgot Holder is gone. The same holds true for Lynch though.

If this was not 1. the Clinton's 2. Hillary is running of President, we would not be having this conversation. 25-30 years of scandals, and we should be skeptical of anything they are involved in.

Judge orders Clinton Foundation racketeering case to trial

A Florida judge has set a trial date in the racketeering case against the Clinton Foundation and Bill and Hillary Clinton.

 

Judge Donald Middlebrooks of the U.S. District Court for the Southern District of Florida ordered the racketeering, influenced and corrupt organizations, or RICO, case to head to trial January 20, 2016. The order, entered Friday and obtained by the Washington Examiner, came days after Larry Klayman of Freedom of Watch filed a lengthy civil complaint against the Clintons and their foundation in the same court.

 

While the Clinton legal team could settle the case or enter a variety of motions in an effort to derail the lawsuit before the trial, the judge's swift decision means the matter could go to court before the Feb. 1 Iowa caucus and Feb. 9 New Hampshire primary.

You don’t say! Actually, Rosalind Helderman does, and the Washington Post reporter notes that the smell around the Qatar-Clinton Foundation relationship isn’t just a case of hindsight. Even at the time that the Qataris poured cash into the foundation, allegations of bribery in FIFA’s award of the 2022 World Cup to Qatar had British journalists energized. Add in the worker conditions for the venues being built, and it all adds up to a very odd — and corrupt — choice:

According to the foundation’s Web site, which lists donors based on the amounts of their total contributions organized by ranges, the Qatari committee gave between $250,000 and $500,000. The Persian Gulf nation, known for seeking to build alliances in Washington by giving money to think tanks and other influential organizations, has given the Clinton Foundation between $1 million and $5 million over the years, according to the charity’s Web site.

The potential problems of associating with the Qatar World Cup effort were clear well before the foundation’s 2013 event. In May 2011, five months after Qatar won the right to host the cup, members of the British parliament alleged that some on FIFA’s executive committee had been paid millions to award the bid to Qatar, and British media had aggressively investigated the issue.

And in July 2012, FIFA appointed former U.S. Attorney Michael J. Garcia to probe the bid process for the 2018 and 2022 World Cups, an investigation that was underway at the time of Qatar’s sponsorship of the Clinton Global Initiative. …

Allegations of bribery weren’t the only problems facing the Qataris at the time of the CGI event. That same week, the Guardian newspaper published an expose of labor conditions at World Cup construction sites in Qatar, concluding that dozens of migrant Nepalese workers had died that summer alone — and estimating that thousands would die before the projects were finished.

Donations to Hillary Clinton’s family charity from a Swiss bank leapt tenfold after she intervened as America’s top diplomat to broker a deal which helped it to avoid prosecution in the US.

 

The disclosure that UBS ploughed cash towards Mrs Clinton’s family — including a payment of $1.5 million to Bill Clinton for speaking events — adds to a rocky period for her presidential campaign.

 

Recent polls suggest that Mrs Clinton is losing to Republicans in battleground states. At the same time, a scandal over her handling of state secrets in private emails shows no sign of abating and surveys indicate that many Americans do not trust her.
