Eric Holder To Step Down As Attorney General

Eric Holder Jr., the nation's first black U.S. attorney general, is preparing to announce his resignation Thursday after a tumultuous tenure marked by civil rights advances, national security threats, reforms to the criminal justice system and five and a half years of fights with Republicans in Congress.

 

Two sources familiar with the decision tell NPR that Holder, 63, intends to leave the Justice Department as soon as his successor is confirmed, a process that could run through 2014 and even into next year. A former U.S. government official says Holder has been increasingly "adamant" about his desire to leave soon for fear he otherwise could be locked in to stay for much of the rest of President Obama's second term.

 

Holder already is one of the longest serving members of the Obama cabinet and ranks as the fourth longest tenured AG in history. Hundreds of employees waited in lines, stacked three rows deep, for his return in early February 2009 to the Justice Department, where he previously worked as a young corruption prosecutor and as deputy attorney general — the second in command — during the Clinton administration.

Prediction: There will be no AG to replace him. Ohaha will name "In yo Face" outrageous appointee after outrageous appointee, while the Senate shoots them down one by one. Even Rats will find the replacements too distasteful. If this story is true (I'd place wagers on that supposition), we'll have an "Acting AG" or Holder will stay until 2017. The "blind-eye policy" will not change either way.

 

My predictions have flown wide of the mark in the past, so YMMV.

With the news that Attorney General Eric Holder is resigning — planning to step down as soon as President Obama names a successor and moves him through Senate approval — the inevitable speculation begins. Who will be Obama’s pick to fill Holder’s very big shoes — and to provide the kind of political cover and policy support Obama and company will expect and demand?

 

One person who has been frequently been suggested is Deval Patrick, currently the Governor of Massachusetts. From NBC News:

Patrick, who – like Holder – is African-American, is retiring from the governorship after eight years in the job. But there could be a slight hiccup with that choice: Massachusetts has a vacancy at lieutenant governor, so there isn’t a natural successor who could replace Patrick if he were picked and confirmed before he leaves office.

 

NBC News is also naming another top candidate…someone whose gender and sexual orientation could energize two big segments of the Democrat base the party desperately needs to turn out for the upcoming midterms. If Obama decides to replace Holder with a career prosecutor, a top Democratic Hill aide tells NBC News that one possibility would be retiring U.S. Attorney Jenny Durkan in Seattle, who has been described as the first openly gay U.S. attorney.

 

Breitbart News recently reported that the prosecutor behind the indictment of conservative author and filmmaker Dinesh D-Souza could be in the running.

 

Preet Bharara, a former staff member to Senator Chuck Schumer, helped lead the Senate Judiciary Committee investigation into the firing of U.S. attorneys by the Bush administration. As the U.S. Attorney for Southern District of New York, he has received glowing press accounts from the media for cracking down on insider trading.

 

Another name in the speculative mix: Solicitor General Donald B. Verrilli, Jr. — identified by NPR as “the man behind the defense” of ObamaCare.

 

Whoever Obama names to replace the Attorney General who has loyally provided cover and protection for this president, it’s highly likely that nomination will be made very soon — possibly even later today.

A look at some possible replacements being mentioned:

 

Massachusetts Gov. Deval Patrick: A close friend of President Obama, Patrick is not running for re-election in November. He has long been mentioned as a possible replacement for Holder. Patrick was chief of the Justice Department's civil rights division under Bill Clinton. As governor, Patrick won raves for his handling of the Boston Marathon bombing and its aftermath. Patrick said Thursday that attorney general is "an enormously important job but it's not one for me right now."

Amy Klobuchar: The senior senator from Minnesota presumably would have an easier time getting confirmed by her colleagues. Before she was elected to the Senate in 2006, Klobuchar was the Hennepin County attorney.

As he prepares to resign, many groups and lawmakers were quick to tout much of Holder’s work over six years as the nation’s top attorney, but several still hold a lingering gripe that he failed to do enough to bring bad actors in the financial sector to justice.

 

Holder was given the job of dispensing justice in the wake of one of the nation’s worst financial crises. And while his agency racked up some of the largest settlements ever against some of the biggest names in finance, he did not bring criminal charges against top executives at many of the institutions that were central to that collapse. Lawmakers on both sides of the aisle have been quick to bring that up repeatedly.

Holder exposed himself to further criticism in 2013, when he suggested at a congressional hearing that it was difficult to bring charges against some large institutions, out of concern that harsh penalties could weigh on the broader economy.

“The size of some of these institutions becomes so large that it does become difficult for us to prosecute them when we are hit with indications that if you do prosecute, if you do bring a criminal charge, it will have a negative impact on the national economy," he told the Senate Judiciary Committee.

HOLDER TO LEAVE, BUT HIS STAIN WILL LINGER

 

There have been worse members of presidential cabinets than Eric Holder. John B. Floyd and Howell Cobb, both of James Buchanan’s cabinet, who apparently aided the South in the days before secession come to mind.

 

In my 40 plus years of observing presidencies, though, Holder has a strong claim on first place. His warped attempts to use the national law enforcement apparatus to remake America along leftist lines would have made his tenure an abomination even if it hadn’t been further stained by racism. But racially stained Holder’s tenure was, as Christian Adams reminds us:

 

[A]fter six years of Holder hugging Al Sharpton, stoking racial division in places like Florida and Ferguson, after suing police and fire departments to impose racial hiring requirements, after refusing to enforce election laws that protect white victims or require voter rolls to be cleaned, after launching harassing litigation against peaceful pro-life protesters, after incident after incident of dishonesty and contempt before Congress — after all this, it was clear to anyone with any intellectual honesty that this man had a vision of the law at odds with the nation’s traditions.

 

Why would it surprise anyone he behaved as he did? As I made clear in my book Injustice, he carried around a quote in his wallet for 40 years about race that, he explained to the Washington Post, indicated that he had common cause with the black criminal. That’s a fact. That’s who he is. . . .

Moments after word came down Thursday that U.S. Attorney General Eric Holder plans to retire, constitutional expert Ilya Shapiro had this to say:

 

“With Eric Holder’s departure, the nation can begin to heal.”

 

Shapiro, senior fellow in Constitutional Studies at the libertarian Cato Institute, labels Holder’s nearly six years at the post the “most divisive tenure of any attorney general” that he can recall, with Holder “tearing the country apart on racial and partisan lines.”

 

“From politicizing Justice Department hiring beyond the wildest accusations against the Bush administration, to running a bizarre guns-to-gangs operation that even Alberto Gonzales couldn’t have concocted, to advocating a racial spoils system at all levels of government, Holder has tarnished the nation’s highest law enforcement office more even than Nixon’s AG John Mitchell,” Shapiro wrote in a column published Thursday.

 

Eric Himpton Holder Jr. held a lot of firsts in prosecution. In 1997, serving as U.S. attorney for Washington, D.C., Holder was nominated by President Bill Clinton and unanimously confirmed in the U.S. Senate as the first black deputy attorney general.

 

Holder made history again when his long-time pal, President Barack Obama, tapped him to become the first black U.S. attorney general.

Remember, Reid changed the rules to allow just 51 votes to confirm. Reid has given WH assurances this will be prior to end of year just in case Republicans take back the Senate with the November votes. The confirmation process will be highly politicized, with Dems hoping it can be used as part of an anti-Republican media blitz shortly before the November Midterms. The resignation of Eric Holder as attorney general is an unavoidably symbolic moment for an administration that itself appears to be stumbling through the final years of a troubled second term. Holder truly personifies an administration of unrivaled ambitions colliding with inescapable realities.

He proved a fierce friend to President Obama, and that loyalty might have worked to the disadvantage of both men. After a series of major court defeats and public controversies, Obama (like President Bush before him) might have been served better by an attorney general who was more detached from him and more attached to the constitutional principles that shape both their offices.

Attorney General Eric Holder, the first Black man to be appointed as United States Attorney General, has resigned. Americans who suffered the slings and arrows of rising above the racial divide since – and before – the enactment of Civil Rights legislation are jubilant in his departure. Never before has an Attorney General belittled the American citizenry as Mr. Holder has in his comments on racism. Never before has an Attorney General abused the power of his office as Mr. Holder has in the pursuit of racial retribution. And never before has an Attorney General overseen such an aggressive division of our citizenry based on race as has Mr, Holder. To put it directly, Mr. Holder, don't let the door smack you in your racist behind as you leave. I was raised in the 1960s and 1970s. My parents taught me, in no uncertain terms, to consider individuals through a lens that evaluated their character, not their skin color. When I didn't, my attitude was "adjusted" and I am thankful for their unyielding insistence on that issue.
