Is the BLM killing the “trespass cattle” in Nevada? Questions are compounding as violence broke out Wednesday. Supporters and family members confronted rangers who tried to block the roadway. Eventually they left, but not until violence broke loose.

 

On Wednesday, an altercation with the Bundy family and supporters resulted in the tasing of Clive Bundy’s son Ammon, and Clive’s sister Margaret Houston, 57, who has cancer, being shoved to the ground. Another woman, one who is pregnant, had a BLM K-9 lung at her. Militia groups have started to arrive, as well as other citizens who are incensed at the government’s treatment of a cattle rancher. The Bundy family is surrounded by armed federal agents. Snipers are in place. The federal govt would love to get its hooks on Clive Bundy, but family members are making sure he has plenty of company when he leaves the house. It appears the Bundy family is about to get more “company” from American citizens fed up with the government’s approach. ‘Expect To See A Band Of Soldiers’: Militia Members Arrive At Nevada Ranch

LAS VEGAS (CBS Las Vegas/AP) — Militia groups are rallying behind a rancher whose cattle are being seized by the federal government.

“We need to be the barrier between the oppressed and the tyrants,” Ryan Payne of the West Mountain Rangers told the Review-Journal. “Expect to see a band of soldiers.”

 

Payne said that militias from New Hampshire, Texas and Florida are likely to join and stand with Bundy and stay at his ranch.

 

“They all tell me they are in the process of mobilizing as we speak,” Payne told the Review-Journal, adding that hundreds of militia members are expected.

 

The Review-Journal also reports that Bundy’s son, Ammon Bundy, was shot with a stun gun by law enforcement officers Wednesday and that the rancher’s sister, Margaret Houston, was pushed to the ground.

 

“I pulled the tasers out of him,” Cheryl Teerlink told the Review-Journal. Scissors-32x32.png

Bundy Ranch, the Federal Government, and the Nevada Water Tipping Point

Many Americans have been watching with great consternation the ongoing struggle between the Federal Bureau of Land Management (BLM) and the U.S. Marshals against Cliven Bundy and his family. There are no signs of either side relinquishing its position. Many onlookers have been informed that this dispute is over protecting the desert tortoise. But it is nothing of the sort. In fact, the reality of the dispute goes far underneath what is being talked about. The more appropriate source of the dispute is ground water as well as surface water – this is a war over water.

 

Cliven Bundy and his family claim that they can trace their family ownership back to around the 1870s on their current property in Clark County. This is well before any federal offices such as the EPA, BLM, or water management were created. This corresponds with the Homestead rights that were established during the Lincoln administration in 1862 to entice people to settle the western frontier and expand the U.S. agricultural enterprises. This 19th-century policy was meant to encourage and support settlement by families like the Bundys. Now, over 150 years later, what seemed to be borderless country surrounding small-town Bunkerville in Nevada is an inhospitable petri dish for the experiments of growing federal regulations.

The campaign to round up Cliven Bundy’s cattle has been canceled.

The Bureau of Land Management announced today that federal agents would conclude their one-month operation to seize the 900 cattle roaming on federally owned land about 75 miles northeast of Las Vegas.

 

“Based on information about conditions on the ground, and in consultation with law enforcement, we have made a decision to conclude the cattle gather because of our serious concern about the safety of employees and members of the public,” BLM Director Neil Kornze said in a statement.

 

“We ask that all parties in the area remain peaceful and law-abiding as the Bureau of Land Management and National Park Service work to end the operation in an orderly manner,” he said.

 

A scuffle between the BLM and Bundy’s supporters broke out earlier this week when agents subdued Bundy’s son with a stun gun and knocked his daughter to the ground. Scissors-32x32.png

The Real Story Behind The Bundy Ranch Harassment

By now you’re familiar with the standoff between the federal government, i.e. the Bureau of Land Management, and 67 year-old rancher Cliven Bundy. (If not, check the backstory and my radio interview with him here.) The BLM asserts their power through the expressed desire to protect the endangered desert tortoise, a tortoise so “endangered” that their population can no longer be contained by the refuge constructed for them so the government is closing it and euthanizing over a thousand tortoises. The tortoises, the excuse that BLM has given for violating claims to easements and running all but one lone rancher out of southern Nevada, is doing fine. In fact, the tortoise has lived in harmony with cattle in the Gold Butte, Clark County Nevada for over a hundred years, or as long as Cliven Bundy’s family has lived on the land as ranchers. In fact, the real threat to it is urbanization, not cattle.

 

A tortoise isn’t the reason why BLM is harassing a 67 year-old rancher. They want his land. The tortoise wasn’t of concern when Harry Reid worked BLM to literally change the boundaries of the tortoise’s habitat to accommodate the development of his top donor, Harvey Whittemore. Whittemore was convicted of illegal campaign contributions to Senator Reid. Reid’s former senior adviser is now the head of BLM. Reid is accused of using the new BLM chief as a puppet to control Nevada land (already over 84% of which is owned by the federal government) and pay back special interests. The Bundy Affair Is the Tip of the Iceberg To What’s Coming

The BLM has tucked their tail between their legs and run for cover. Sheriff Mack, the other sheriffs, various state legislators, Oath Keepers and average people who make up our militias personify the words courage, integrity and honor. May God bless and protect every brave soul who went to the aid of a beleaguered family. Our American heroes prevented another Ruby Ridge and Americans should forever be grateful to all who went to the aid of Cliven Bundy. America still has many great people who are worthy of the descriptive term, hero. Cliven Bundy has also demonstrated to the world what is means to be an American and stand up to tyranny and win. Like so many overreaching federal agencies, when confronted, they are cowards and they tuck their collective tails between their legs and run for cover.

The Clark County (NV) Commissioners are on the hook for that money. This is why one of their own threatened to send anyone traveling to the aid of Bundy home in a body bag. The militarized siege of a cattle ranch near Bunkerville, Nevada has drawn national attention as dozens of federal agents, armed with machine guns, sniper rifles, helicopters, and more, have descended on the ranch to seize cattle, people, and generally show everyone who’s boss.

The conservative press has framed the story in a variety of ways, casting the story both as matter of outright federal seizure of private land, and as an absurd environmental crusade to save a tortoise from extinction.

The reality looks to be a little murkier, however, as is often the case when dealing with land ownership in the American West. Back in September, the Las Vegas Sun reported on the Bundy family and noted that troubles began 20 years ago when the family’s patriarch unilaterally determined that he would no longer pay the Bureau of Land Management use fees that have long been required to graze on federal lands. The exact legal and historical details of the Bundy family’s case will emerge slowly over time, but even if the family is completely in the wrong legally (which it probably is), it’s safe to say that taxpayer dollars might be better spent on things other than a shock and awe campaign waged against a tiny ranch in the middle of a Nevada desert. Nonetheless, this is just the latest dispute in a long history of ranchers jockeying with the Federal government over land use permits and land use regulations.[1]

Turtles and cows have absolutely no relevance to the situation in Nevada. Does the Constitution make provision for the federal government to own and control “public land”? This is the only question we need to consider. Currently, the federal government “owns” approximately 30% of the United States territory. The majority of this federally owned land is in the West. For example, the feds control more than 80% of Nevada and more than 55% of Utah. The question has been long debated. At the debate’s soul is Article IV, Section 3, Clause 2 of the Constitution, which is know as the “Property Clause”. Proponents of federal expansion on both sides of the political aisle argue that this clause provides warrant for the federal government to control land throughout the United States.

 

The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States…. Scissors-32x32.png

The Property Clause and Northwest Ordinance are both limited in power and scope. Once a state is formed and accepted in the union, the federal government no longer has control over land within the state’s borders. From this moment, such land is considered property of the sovereign state. The continental United States is now formed of fifty independent, sovereign states. No “unclaimed” lands are technically in existence. Therefore, the Property Clause no longer applies within the realm of federal control over these states.Scissors-32x32.png

Though there may have been a time when this was somewhat true, during the Barack Obama presidency this theory has been ripped to shreds.

 

Harry Reid and the Bureau of Land Management are easy targets in the Cliven Bundy land grab case but, as usual, there are higher powers that are pulling the strings. The White House was quiet during this incident, which should have been our first clue that Barack Obama was involved and simply attempting to avoid the bad public relations that might result.

This retreat did not come as a measure of good will by the government. It came after hundreds, if not thousands, of armed Americans came to the aid of the Bundys.

Americans were outraged as they saw video of relatives of the Bundys being knocked to the ground or being Tasered by uniformed government agents. They were outraged as they saw federal agents attacking peaceful protesters, sometimes with dogs, and restricting the First Amendment rights of citizens to a small, penned-in area miles away from the Bundy Ranch.

Americans were appalled by the spectacle of federal agents, armed with military-grade firepower, attacking American citizens.

Bundy Ranch Press Conference 4-14-2014- The Fight is Not Over

The Bundy Ranch- one small victory in a battle over America

 

The Bundy Ranch held a press conference at 1 pm (1300) Pacific time on 4-14-2014. In the moments leading up to the conference, confusion nearly created panic. But the conference cleared up many of the rumors: the Bundy family is alive and well, the ranch is ok, there are still protesters on site, as well as militia members there to help protect.

 

Damage

 

The BLM damaged some water tanks, according to both people on the ground and family members at the Press Conference. They cut some fences that will have to be rehung, and there was some abuse of the cattle. They have 27 calves that are without mothers that the Bundy’s have been trying to nurse back to health. They are hoping to reunite them with mother cows in the near future.

Bureau of Land Management officials destroyed water lines and water tanks belonging to the Cliven Bundy family. The feds also shot two prized bulls and ran over at least one endangered tortoise den.

I do, if he (Bundy) stops acting like he a lawer he will win under, The Property Clause and Northwest Ordinance are both limited in power and scope. Once a state is formed and accepted in the union, the federal government no longer has control over land within the state’s borders. least I hope he does
