The Zimmerman Arrest Affidavit - Hold The Cheers

Scissors-32x32.png

Let me open with a quick survey of reaction to the Zimmerman arrest affidavit from around the blogosphere.

Alan Dershowitz: "not only thin, it’s irresponsible.”

Jeralyn Merritt: "Affidavit = FAIL.

Ken of Popehat: "The affidavit is argumentative, it's conclusory, and it lacks attribution."

David French of NRO was a fan! Andrew McCarthy, also of NRO, brings him down gently ("it is agitprop").

Mark Levin thunders from the right.

"Bmaz" thunders from the left: "wholly deficient". I am not familiar with 'Bmaz' but he is posting at Marcy Wheeler's site and if he/she has 80% of Ms. Wheeler's researching ability that is 120% more than enough to impress me.

I haven't run across any posts (other than the French kiss for Corey) gushing over the lack of substance and the segues to the passive voice in this affidavit. But I welcome suggestions.

Where’s the ‘Probable Cause’?

The affidavit in the Zimmerman case fails to justify a second-degree-murder charge.

By John R. Lott Jr.

The charges brought against George Zimmerman sure look like prosecutorial misconduct. The case as put forward by the prosecutor in the “affidavit of probable cause” is startlingly weak. As a former chief economist at the U.S. Sentencing Commission, I have read a number of such affidavits, and cannot recall one lacking so much relevant information. The prosecutor has most likely deliberately overcharged, hoping to intimidate Zimmerman into agreeing to a plea bargain. If this case goes to trial, Zimmerman will almost definitely be found “not guilty” on the charge of second-degree murder.

The prosecutor wasn’t required to go to the grand jury for the indictment, but the fact that she didn’t in such a high-profile case is troubling. Everyone knows how easy it is for a prosecutor to get a grand jury to indict, because only the prosecutor presents evidence. A grand-jury indictment would have provided political cover; that charges were brought without one means that the prosecutor was worried that a grand jury would not give her the indictment.

The affidavit consists of six main points: Scissors-32x32.png

Little-Known Department of Injustice Cell Watches Trayvon Martin Protests

http://www.whitehousedossier.com/2012/04/17/secretive-doj-force-watces-trayvon-protests/

A largely unknown group of Justice Department officials has inserted itself into the local Florida protest movement surrounding the killing of Trayvon Martin, assisting the protestors and attending their meetings and rallies.

While the officials are tasked with preventing racial violence, it appears that in carrying out their duties, they have provided significant assistance to those protesting the killing of Martin, who black, by George Zimmerman, who is half white and half Hispanic.

The officials are members of the DOJ’s Community Relations Service, also known as “The Peacemakers,” a special unit established under the 1964 Civil Rights Act and empowered to act to mitigate local tensions between ethnic groups.

Scissors-32x32.png

There is a secretive aspect to the group’s activities, although officials assert this is to facilitate participation in The Peacemakers mediation efforts. According to Main Justice, officials are barred from revealing the identity of parties participating in negotiations overseen by the CRS.

George Zimmerman Passed Police Lie Detector Test Day After Trayvon Martin Killing

A day after killing Trayvon Martin, George Zimmerman passed a police lie detector test when asked if he confronted the teenager and whether he feared for his life “when you shot the guy,” according to documents released today by Florida prosecutors.

According to a “confidential report” prepared by the Sanford Police Department, Zimmerman, 28, willingly submitted to a computer voice stress analyzer (CVSA) “truth verification” on February 27. Investigators concluded that he “has told substantially the complete truth in regards to this examination.”

Zimmerman, the report noted, “was classified Scissors-32x32.png Read More http://www.thesmokinggun.com/buster/george-zimmerman-lie-detector-421395

George Zimmerman Lynching Further Unravels

The files recently released by his defense strongly suggest innocence.

By

George Zimmerman has been the subject of the most transparent and vicious media and law enforcement lynchings since the FBI tried to blame hero security guard Richard Jewell for the 1996 Olympics bombing carried out by Eric Robert Rudolph.

Jewell’s actions to move people away from a suspicious backpack bomb saved countless lives. Zimmerman, a neighborhood watchman in Sanford, Florida, shot Trayvon Martin during a beating he suffered at the hands of the teen. Zimmerman had been attempting to keep him in sight for police responding to the scene to determine why Martin was loitering on a cold rainy night in front of a home that had been recently burglarized.

Zimmerman’s defense team released a collection of files to the public and media last month. The files included Zimmerman’s written statement to police about the shooting, audio interviews of Zimmerman with Sanford Police Department investigators, a video interview of Zimmerman passing a computer voice stress analyzer (CVSA) lie detector test, and a video walk-though by Zimmerman (incorrectly described as a re-enactment) of the incident 22 hours after the shooting.

Despite erroneous media claims, George Zimmerman’s next-day account tracked well with both the physical and medical evidence recovered at the scene of the shooting and with the recording of the non-emergency call he made the night before.

An underreported fact of the investigation: the almost foolishly transparent way Zimmerman cooperated with police, refusing to obtain an attorney until long after he’d completed his interviews and follow-up interviews with the Sanford Police’s investigators.

When local, state, or federal law enforcement officers are involved in a shooting, they are immediately told not to say anything about the shooting to investigators for at least two to three days — more importantly, two to three sleep cycles – -after the incident. The same advice holds true for civilians with competent attorneys. The reasoning behind this delay is based upon how the mind stores and accesses memories of high-stress events, and how the same chemical cocktail of hormones that triggers the “fight or flight”Snip Read More http://pjmedia.com/blog/george-zimmerman-lynching-further-unravels/
